HomeMy WebLinkAbout021696 ORD - 06/29/1993AN ORDINANCE CLOSING AND ABANDONING A 20 -FOOT WIDE BY 267 -FOOT LONG EASEMENT WITHIN LOTS A-1 AND A-2, AND A 5 -FOOT WIDE BY 133 - FOOT LONG EASEMENT WITHIN LOT A-1 OF 2.659 ACRE TRACT OUT OF LOT 18, SECTION 2, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS (OTHERWISE KNOWN AS HABLUETZEL SUBDIVISION), SUBJECT TO APPLICANT MEETING SPECIFIED CONDITIONS; SUBJECT TO REPLATTING WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 20 -foot wide by 267 -foot long easement within Lots A-1 and A-2, and a 5 -foot wide by 133 -foot long easement within Lot A-1 of 2.659 acre tract out of Lot 18, Section 2, Flour Bluff and Encinal Farm and Garden Tracts (otherwise known as Habluetzel Subdivision) shown by plat recorded in Volume 20, Page 2, Map Records, Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon some of these easements, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That the 20 -foot wide by 267 -foot long easement within Lots A-1 and A-2, and a 5 -foot wide by 133 -foot long easement within Lot A-1 of 2.659 acre tract out of Lot 18, Section 2, Flour Bluff and Encinal Farm and Garden Tracts (otherwise known as Habluetzel Subdivision), shown by plat recorded in Volume 20, Page 2, Map Records, Nueces County, Texas, as shown on Exhibit A, and the same are hereby closed for public use and every municipal purpose. SECTION 2. That the above listed easements be closed and abandoned subject to the following provisions: 1) Applicant replatting said property within 180 days of passage of this ordinance, provided however, the City Engineer may extend the time limit for an additional one hundred (180) days if extenuating circumstances outside the applicant's control necessitate an extension; 2) Applicant submitting construction plans for approval on the relocation of the 8 -inch V.C.P. Sanitary Sewer Line and relocating the sanitary sewer line at applicant's expense. 3) Applicant paying the Fair Market Value of the property in the amount of $8820. AC6000376ajr 021596 M$QFILMEV 4) Applicant dedicating a 10 -foot wide utility easement at a location approved by the City Engineer. SECTION 3.
