AN ORDINANCE
AMENDING ORDINANCE 17728, AS AMENDED, BY ADDING A NEW SECTION III, LUMP -SUM
PAYMENT AUTHORIZING A ONE-TIME LUMP -SUM PAYMENT TO CERTAIN EMPLOYEES. AMEN-
DING ORDINANCE 3658, SUBSECTIONS 251 THROUGH 257 REVISING CLASSIFICATION
SCHEDULES AND SUBSECTION 102 CLARIFYING GENERAL QUALIFICATIONS FOR CERTAIN
CLASSIFICATIONS. AMENDING ORDINANCE 8127, SECTION 501, BY REPLACING SALARY
SCHEDULES A AND B WHICH HAVE GRADES AND STEPS WITH REVISED SALARY SCHEDULES A
AND B WHICH HAVE GRADES AND RANGES. AMENDING ORDINANCE 8127, SECTION 510,
MANAGERIAL PAY PLAN, 1992-93, BY REPLACING IT WITH A REVISED MANAGERIAL PAY
PLAN FOR FY 93-94 PROVIDING FOR A FOUR PERCENT (4%) INCREASE TO THE POLICE
MANAGERIAL SALARY RANGES EFFECTIVE AUGUST 9, 1993, WHICH ARE CONSISTENT WITH
THE POLICE COLLECTIVE BARGAINING AGREEMENT. AMENDING ORDINANCE 8127, SUBSEC-
TIONS 551.1, 551.2, 551.3, 551.5, 551.6, 552.1, 552.2 and 652 BY REPLACING
REFERENCES TO "STEPS" WITH "RANGE." AMENDING ORDINANCE 8127, SUBSECTION 708.1
TO CORRECT CLASSIFICATION TITLE. AMENDING ORDINANCE 8127, BY ADDING SUBSEC-
TIONS 654.0, 951.15, AND 952.15 AND AMENDING SUBSECTIONS 951.6, 951.11, 952.4,
952.9, 952.12, AND 955.1 TO BE IN COMPLIANCE WITH THE MEDICAL AND FAMILY LEAVE
ACT. PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS:
SECTION 1. That Ordinance 17728, as amended, be amended by adding a new
Section III to read as follows:
The City Manager is authorized to make a one time lump -sum pay-
ment, effective on or about December 10, 1993, to be based upon
annual salary, of approximately 3 percent to all eligible employ-
ees in Salary Schedule A, Grades 8 through 11, and an approximate
2% one-time lump sum payment to other eligible employees in Salary
Schedules A and B and the Managerial Pay Plan who are on the
payroll as of August 1, 1993, and who continue to be on the
payroll as of November 28, 1993, except for the following exclu-
sions: all uniformed Police and Fire personnel except the Police
and Fire Chiefs; all employees hired after August 1, 1993, except
for reinstated employees who otherwise meet all requirements; all
employees who terminate for whatever reason on or before November
28, 1993; all temporary employees except those who were hired on
or before August 1, 1993, and who have subsequently been placed in
non -temporary positions and who otherwise meet all requirements;
all employees on inactive status except those on approved medical,
family, or military leave; all employees in Grades 1 through 7. A
part-time employee's lump sump payment shall be prorated based on
the Percentage granted times the employee's annual part-time
salary. For employees whose base hours exceed 40 hours per pay
period, the lump -sum payment will be based on 40 hours.
SECTION 2. That Ordinance 3658, as amended, Section 250, Classification Plan
for All Positions in the Classified Service, Subsections 251 through 257 be
amended by amending Sections 251, 252, 253, 254, 255, 256, and 257 to read as
shown in Exhibit A.

SECTION 3. That Ordinance 3658, as amended, Section 102, Preparation of
Content of Class Classification, be amended to read as follows:
102 Class specifications shall be prepared by the Civil Service
Director and reviewed with the City Manager or his designated
representative, before advertising or interviewing to fill classi-
fications. Class specifications shall define the essential
functions of all positions and the minimum entrance qualifications
for successful performance of such essential functions. In
addition to the specific qualifications, as -set -forth -in -the -class
spee4fieatian, it shall be understood that all sane positions
require: ability to read, write, speak, and understand the
English language and to follow written and oral instructions;
ability to get along with others; thoroughness, accuracy, sobri-
ety, integrity, loyalty, and a record of orderly law-abiding
citizenship.
SELIIGN 4. That Ordinance 8127, as amended, Section 510, Managerial Group
Pay Plan 1992-93, be amended by amending Section 510 to read as shown in
Exhibit B and approving an approximate four percent (4%) range adjustment
limited to Police Managerial classifications within the Managerial Group to
become effective August 9, 1993.
SECTION 5. That Ordinance 8127, as amended, Section 501 Salary Schedules, be
amended by deleting Salary Schedules A and B, which have designated grades and
steps, and replacing them with revised Salary Schedules A and B, with grades
and ranges as shown in Exhibit C.
StutiON 6. That Ordinance 8127, as amended, Section 551, Entrance Salary
Rates, Subsections 551.1, 551.2, 551.3, 551.5, 551.6, with revised Subsections
551.1, 551.2, 551.3, 551.5, and 551.6 to read as follows:
551.1 Starting Rate on Initial Employment.
On original appointment to any position classified in Salary
Grades 8 through 17, the salary advancement within the range of a
Grade shall be by--sneeessive-steps--with-progression based upon
performance. The City Manager may approve initial compensation
for positions in Grades 8 through 17 at any rate between the
minimum and MIDPOINT of the range at-the-B-threugh-e-1-step in the
appropriate salary grade when the experience, skill, training or
labor market conditions justify the action. The City Manager may
approve initial compensation in Salary Grades 18 through 43 at any
rate between the midpoint and the maximum of the range at -the -8
threugh-F-l--step in the appropriate Salary Grade when exceptional
experience, training or labor market conditions justify the action
and to any salary amount between the minimum and maximum annual
salary range for positions in the Managerial Classifications.
551.2 Starting Rate on Return to Duty.
Fn ployees other than Fire and Police personnel returning to duty
in the same class of positions after a separation from the City
service of not more than one year, which separation was without
prejudice to the employee, may, at the discretion of the City
Manager, receive the rate in the salary schedule corresponding to
the step rate received at the time of separation. -and-shall
subsequently-be--paid-such-rete--for-at--least-such--permed-as--is
nennally-required-€er-advancement te- the -next higher salary rates
Subsequent advancement to higher rates in the grade will be on the
same basis as described in Section 552. Fire and Police personnel
after reappointment as Firefighter or Police Officer, respective-
ly, returning to duty with a separation from the City Service,
which separation was without prejudice to the employee, nay, at
the discretion of the City Manager, receive recognition for prior
experience and training by being placed in a longevity pay step
for Police Officer or Firefighter corresponding with actual prior
service with the City as Police Officer or Firefighter in the same
division; but in no cage shall prior training and experience be
recognized in a step greater than the actual prior service with
the City in the same division shall justify.
551.3 Starting Rate on return from Military Service.
Any employee who leaves or has left the City service to enter the
active service of the armed forces of the United States and who
subsequently is reinstated to a position previously .held by such
employee him shall be entitled to receive a salary at the step
rate to which he the employee would have been entitled had his
such service with the City not been interrupted by service in the
armed forces, assuming his the employee's manner of performance to
be that evidenced prior to his such military service.
551.5 Rate of Pay on Pronation.
In any case where an employee is promoted to a classification with
a higher grade designation, with the exception of positions in the
Managerial Group, the entrance salary rate shall be at a step rate
within the range of the higher grade which will provide an in-
crease over the salary received immediately prior to such promo-
tion. Such increase in salary rate may be authorized up -to -fear
additienal steps -over the -salary received immediately prier to -the
promotion up to the lowest rate in the higher grade which results
in a minimum increase of 5% up to a maximum increase of 10% over
the salary received immediately prior to the pronation. Subse-
quent advancement to -higher -steps within the range of in the grade
will be on the same basis as described in Paragraph Section 552.
Salary levels resulting frau appointments to Council -appointed
positions within the Managerial Group shall be determined solely
by the City Council.

551.6 Rate of Pay on Classification Series Changes.
An employee advanced to a higher salary grade as a result of a
classification change, with the exception of changes within the
Managerial Group, shall be advanced to the appropriate step rate
in the higher grade which provides te-provide a salary increase
over the salary received immediately prior to the classification
change. Such advancement may be granted up -to -€aur --steps up to
the lowest rate in the higher grade level which results in a
minimum increase of 5% up to a maximum increase of 10% over the
salary received immediately prior to the classification change.
All subsequent step advancements shall be granted in conformity
with Section 552.
SHUION 7. Amend Ordinance 8127, as amended, Section 552, Advancement of
Salary Within a Salary Schedule, Subsections 552.1 and 552.2 by replacing then
with revised Subsections 552.1 and 552.2 to read as follows:
552.1 Notwithstanding any other provision to the contrary,
there is no automatic salary adjustment based on
longevity, but salary advancements shall be based on
performance. Advancement in each salary schedule
shall be based on a review of annual job performance.
Salary advancements to a higher rate within the Grade
may be authorized up -fie- the next four steps in the
grade as percentage increases which range from 0%-10%
to be determined as directed by the City Manager.
More frequent evaluation of job performance may be
conducted as deemed appropriate.
552.2 The first review of job performance for consideration
of salary advancement shall occur six months after
appointment, or promotion or other classification
change to a position at the entry -step -or minimum of
the salary range and twelve months after appointment,
or promotion or other classification change to a posi-
tion above the entry-}eve}--step-.er minimum of the
salary range. Review thereafter shall be completed on
the employee's anniversary date, which shall be de-
fined as the month of appointment, or promotion or
other classification change to the position currently
held by the employee.
SOCPION 8. That Ordinance 8127, as amended, Section 650, Compensation of
Part -Time Employees, be amended by replacing Subsection 652, Advancement in
Salary for Part -Time Employees, with a revised Subsection 652 to read as
follows and by adding a new Subsection 654, Eligibility of Part-time Employees
For Coverage Under the Family and Medical Leave Act, to read as follows:

652. A part-time employee may be advanced in pay within a salary
schedule in the same manner as other employees, provided that only
actual hours of work shall be considered in determining such
advancement. When the hourly equivalent of required periods of
service has been attained, advancement to the higher step rate may
be affected in accordance with Section 550 of this Ordinance.
654. A part-time employee, who is not eligible to accrue sick leave,
vacation or personal leave, may be eligible for a total of 12
workweeks of leave without pay during any 12 month period, as
required by the Family and Medical Leave Act and as provided by
City Policy. To be eligible, the employee must have been employed
by the City for a minimum of 12 months, oust have worked a minimum
of 1,250 hours, or more, in the last 12 months, and must otherwise
meet the eligibility requirements for such leave as set out in the
City's Official Policy regarding Leaves.
SECTION 9. That Ordinance 8127, as amended, Section 700, Special Compensa-
tion Provisions, Subsection 708.1, Productivity, Safety or Incentive Programs,
be amended to read as follows:
708.1 The City Manager nay authorize the implementation of productivity,
safety, or incentive programs and approve the departmental proce-
dures established for the implementation of these programs where
these have been evaluated by the Director of Personnel--and-Lieber
Relations Human Resources for a determination of the affects of
the Fair Labor Standards Act on the program.
SECTION 10 That Ordinance 8127, as amended, Section 950, Leaves of Absence,
951.0, Plan I Employees, Subsection 951.6, Vacation in Lieu of Sick Leave, be
amended to read as follows:
951.6 Personal Leave and Vacation in Lieu of Sick Leave
When accrued sick leave is exhausted, Aabsence eine--te for sick-
ness, injury, or disability in excess of any leave authorized for
such reason, authorised €er sueh purposes may shall be automa-
tically charged against the employee's remaining personal leave
allowance, if any, and the employee's accrued vacation leave, if
any, in that order. allewanee if -requested by the -employee --and
approved by the -department head. Such leave shall be used by the
Plan I employee until exhausted or until the City's Disability
Incase Protection Plan coverage begins. Additional leave without
pay, as required and documented, shall be granted for a combined
maximum total of 12 workweeks, in a 12 month period, for eligible
employees as provided in the Family and Medical Leave Act and City
Policy.

SECTION 11. That Ordinance 8127, as amended, Leaves of Absence, Section
951.0, Plan I Employees, Subsection 951.11, Use of Sick Leave, be amended to
read as follows:

Member: In the event of the death of an employee's immediate
family member, accrued sick leave shall be granted by the Depart-
ment Head after consideration of the employee's request and the
circumstances. The immediate family for these purposes shall be
regarded to include the employee's parents, spouse, children,
brothers, sisters, immediate in-laws, grandparents and grandchil-

An employee employed for a minimum of 12 months and who has worked
a minimus of 1,250 hours in the last twelve months, is eligible
under provisions of the Family and Medical Leave Act of 1993 for a
total of 12 workweeks of unpaid leave during any 12 month period
for one or more of the following reasons: (1) Because of the
birth of a baby to the employee (father or mother) in order to
care for such baby effective the date of birth; (2) because of the
placement of a son or daughter with the employee for adoption or
foster care (father or mother) effective the date of placement;
(3) in order to care for the employee's spouse, or a son, daugh-
ter, or parent of the employee, if such spouse, son, daughter, or
parent has a serious health condition; (4) because of a serious
health condition that makes the employee unable to perform the
essential functions of the position held. Any accrued sick leave,
and other accrued paid leave as indicated in Subsection 951.6,
shall be used by the employee until exhausted with additional
leave as required, for a combined maximum total of 12 workweeks in
a 12 month period, being granted without pay to eligible employ-
ees If both husband and wife are employed by the City and both
are eligible for leave, the total amount of combined leave that
may be taken for child birth, placement, or to care for a sick
parent is limited to 12 weeks.
Definitions to be used in the implementation of this section are
as follows: (1) "son or daughter" means a biological, adopted,
or foster child, a stepchild, a legal ward, or a child of a person
standing in loco parentis, who is under 18 years of age or, if 18
or older, is incapable of self-care because of a mental or physi-
cal disability. (2) A "parent" means a biological parent or an
individual who stood in loco parentis to an employee when the
employee was a child; (3) A "serious health condition" is defined
as "an illness, injury, impairment, or physical or mental condi-

tion" that involves either "inpatient care in a hospital, hospice,
or residential medical care facility" or "continuing treatment" by
a "health care provider", who is a licensed doctor of medicine or
osteopathy or any other person determined by the Department of
Labor to be capable of providing health care services.
An eligible employee who takes leave for the purposes stated in
this Subsection is entitled to be restored to the former position
held or to an equivalent position with equivalent benefits, pay
and other terms and conditions of employment and is entitled to
maintenance of the same group health plan coverage as if the
employee had continued in employment continuously for the duration
of the leave. Such taking of leave shall not result in the loss
of employment benefits accrued prior to the date on which the
leave commenced.
Where an employee can foresee the intent to take leave for child
birth , child placement or planned medical treatment for the
employee or family member, at least 30 days advance notice is
required before the leave is to begin, or if the date is not
foreseeable and 30 days advance notice cannot be given, the
employee must give as much notice as is practicable based on the
circumstances.
In the event of sick leave for any purpose, the department head
may require a certification from the health care provider treating
the employee or family member as to the circumstances involved and
an estimate of the time required to recover or care for a family
member. The employee may be required to obtain a second certifi-
cation from a second health care provider designated by the City
of Corpus Christi at the City's expense. In case of disagreement
with the first opinion, a third, final and binding opinion shall
be obtained at the City's expense from a jointly selected
provider.
Employees shall be subject to the terms and provisions of the
City's Official Policy regarding Family and Medical Leave. Said
policy is incorporated herein by reference to the same extent as
if such policy were set out in full in this section. The City
Manager is authorized to amend the policy as needed.
SEULLON 12. That Ordinance 8127, as amended, Section 950, Leaves of Absence,
Subsection 951.0, Plan I Employees, be amended by adding a new Subsection
951.15, Reinstatement of Leave, to read as follows:
951.15 An eligible Classified employee who is terminated for
his/her medical inability to perform the essential functions of
the position he/she was hired to perform, even with reasonable
accommodation, and who is reinstated following an appeal pursuant
to the Civil Service Board Rules and Regulations, or who while
pending appeal, is placed in another classification with the city
for which he/she can safely and fully perform the essential

functions with reasonable accommodation, shall be credited with
personal leave, which would have been effective, and sick leave
and vacation leave, which would have accrued, had he/she not been
terminated.
SE(.TICN 13. That Ordinance 8127, as amended, Section 952.0, Plan II Employ-
ees, Subsection 952.4, Use of Vacation in Lieu of Sick Leave, be amended to
read as follows:
952.4 Use of Personal Leave and Vacation in Lieu of Sick Leave
Absences--due-he-sieknessinjaryror-dis8bi1#hy-4n-exeess-ef-khat
hereinunder--sutheriaed-€er-seem-purposes, -may, at the request -e€
the--ep1oyee-and-within-the-d#aeration-e€-the-Bepertsnent-Head;-be
charged against vacation leave-allewanee.
When accrued sick leave is exhausted, absence for sickness,
injury, or disability in excess of any leave authorized for such
reason, shall be automatically charged against the employee's
remaining personal leave allowance, if any, and the employee's
accrued vacation leave, if any, in that order. Such leave shall
be used by the Plan II employee until exhausted. Additional leave
without pay, as required and documented, shall be granted for a
combined maximum total of 12 workweeks, in a 12 month period, for
eligible employees as provided in the Family and Medical Leave Act
and City Policy.
SELIION 14. That Ordinance 8127, as amended, Section 952.0, Plan II Employ-
ees, Subsection 952.9, Mandatory Annual Use of Vacation Leave, be amended to
read as follows:
Because vacation leave is a benefit for employees to provide paid
time away from work for purposes of relaxation, personal develop-
ment, and enjoyment of life, and because Plan II Employees may
accumulate vacation leave without limit, all Plan II employees are
required to take a minimum of forty (40) working hours of accrued
vacation leave before the end of eaeh-ea}ender-year the last pay
period of the calendar year as vacation or forfeit that portion of
vacation leave, up to 40 hours, which is not taken.
SELLION 15. That Ordinance 8127, as amended, Section 952.0, Plan II Employ-
ees, Subsection 952.12, Use of Sick Leave, be amended to read as follows:
Any Plan II employee of the Sanitatien--B vision Solid Waste
Services Department required to work on a sixth day in any week
will, when absent on the sixth day due to "sick leave", as direct-
ed below, be charged one full day of sick leave. Siek-teave

In the event of the death of an employee's immediate family
member, accrued sick leave shall be granted at the discretion of
the department head after consideration of the employee's request

children, brothers, sisters, and immediate in-laws, in -any -ease;

leave as required, for a combined maximus total of 12 workweeks in
a 12 month period, being granted without pay to eligible employ-
ees. If both husband and wife are employed by the City and both
are eligible for leave, the total amount of combined leave that
may be taken for child birth, placement, or to care for a sick
parent is limited to 12 weeks.
Definitions to be used in the implementation of this section are
as follows: (1) "son or daughter" means a biological, adopted,
or foster child, a stepchild, a legal ward, or a child of a person
standing in loco parentis, who is under 18 years of age or, if 18
or older, is incapable of self-care because of a mental or physi-
cal disability. (2) A "parent" means a biological parent or an
individual who stood in loco parentis to an employee when the
employee was a child; (3) A "serious health condition" is defined
as "an illness, injury, impairment, or physical or mental condi-
tion" that involves either "inpatient care in a hospital, hospice,
or residential medical care facility" or "continuing treatment" by
a "health care provider", who is a licensed doctor of medicine or
osteopathy or any other person determined by the Department of
Labor to be capable of providing health care services.

An eligible employee who takes leave for the purposes stated in
this Subsection is entitled to be restored to the former position
held or to an equivalent position with equivalent benefits, pay
and other terms and conditions of employment and is entitled to
maintenance of the same group health plan coverage as if the
employee had continued in employment continuously for the duration
of the leave. Such taking of leave shall not result in the loss
of employment benefits accrued prior to the date on which the
leave commenced.
Where an employee can foresee the intent to take leave for child
birth , child placement or planned medical treatment for the
employee or family member, at least 30 days advance notice is
required before the leave is to begin, or if the date is not
foreseeable and 30 days advance notice cannot be given, the
employee must give as much notice as is practicable based on the
circumstances.
In the event of sick leave for any purpose, the department head
may require a certification from the health care provider treating
the employee or family member as to the circumstances involved and
an estimate of the time required to recover or care for a family
member. The employee may be required to obtain a second certifi-
cation from a second health care provider designated by the City
of Corpus Christi at the City's expense. In case of disagreement
with the first opinion, a third, final and binding opinion shall
be obtained at the City's expense frau a jointly selected
provider.
Employees shall be subject to the terms and provisions of the
City's Official Policy regarding Family and Medical Leave. Said
policy is incorporated herein by reference to the same extent as
if such policy were set out in full in this section. The City
Manager is authorized to amend the policy as needed.
SmLrION 16. That Ordinance 8127, as amended, Section 952.0, Plan II Employ-
ees, be amended by adding a new Subsection 952.15, Reinstatement of Leave, to
read as follows:
952.15 An eligible Classified employee who is terminated for
his/her medical inability to perform the essential functions of
the position he/she was hired to perform, even with reasonable
accommodation, and who is reinstated following an appeal pursuant
to the Civil Service Board Rules and Regulations, or who while
pending appeal, is placed in another classification with the city
for which he/she can safely and fully perform the essential
functions with reasonable accommodation, shall be credited with
personal leave, which would have been effective, and sick leave
and vacation leave, which would have accrued, had he/she not been
terminated.

salla i 17. That Ordinance 8127, as amended, Section 955, Special Leave,
Subsection 955.1, be amended to read as follows:
In addition to leaves authorized above, a Department Head may
authorize an employee to be absent without pay for personal
reasons, which are not covered by Sections 951.0 and 952.0, for
periods --net to exceed- a combined maximum total of 30 calendar
days in a 12 month period. Such Leaves without pay in excess of a
combined maximum total of 30 calendar days in a 12 month period
shall require approval of the City Manager, or designee.
SECTION 18. If, for any reason, any section, paragraph, sub -division,
clause, phrase, word or provision of this Ordinance shall be held invalid or
unconstitutional by final judgment of a court of competent jurisdiction, it
shall not affect any other section, paragraph, sub -division, clause, phrase,
word or provision of this Ordinance, for it is the definite intent of this
City Council that every section, paragraph, sub -division, clause, phrase, word
or provision hereof be given full force and effect for its purpose.
SECTION 19. That upon written request of the Mayor or five Council Members,
copy attached, to find and declare an emergency due to the need for the
efficient and effective administration of City Affairs, such finding of an
emergency is made and declared requiring suspension of the Charter rule as to
consideration and voting upon ordinances at two regular meetings so that this
Ordinance is passed and shall taken effect upon first reading as an emergency
measure.

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter
rule as to consideration and voting upon ordinances at two regular
meetings: I/we, therefore, request that you suspend said Charter
rule and pass this ordinance finally on the date it is introduced,
or at the present meeting of the City Council.
