ORDERING A SPECIAL ELECTION TO BE HELD ON NOVEMBER 2,
1993 IN THE CITY OF CORPUS CHRISTI FOR THE CONSIDERATION
OF THE ADOPTION OF AN ADDITIONAL ONE-FOURTH OF ONE
PERCENT SALES AND USE TAX FOR IMPROVEMENTS TO THE WATER
AND WASTEWATER SYSTEMS OF THE CITY AND ACQUISITION OF
WATER RESOURCES FOR THE CITY; PROVIDING FOR HOLDING SUCH
ELECTION; PROVIDING FOR NOTICE OF ELECTION AND
PUBLICATION THEREOF; PROVIDING FOR ESTABLISHMENT OF
BRANCH EARLY POLLING PLACES; DESIGNATING POLLING PLACE
LOCATIONS; AND ENACTING PROVISIONS INCIDENT AND RELATING
TO THE SUBJECT AND PURPOSE OF THIS ORDINANCE; PROVIDING
FOR SEVERABILITY; AND DECLARING AN EMERGENCY.
WHEREAS, it is provided in Section 3.004 of the Texas Election
Code that the governing body shall order elections pertaining to
municipal affairs, give notice and appoint election officers to
hold the election;
WHEREAS, the City Council desires to place before the
electorate of the City of Corpus Christi the adoption of an
additional one-fourth of one percent sales and use tax for
improvements to the water and wastewater systems of the City and
acquisition of water resources for the City, pursuant to
Section 4B, Article 5190.6, Vernon's Texas Civil Statutes;
WHEREAS, it is specifically determined by the City Council
that improvements to the City of Corpus Christi's water and
wastewater systems and acquisition of water resources for the City
are necessary to promote and develop new and expanded business
enterprises.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. That a special election for the consideration of
the adoption of an additional one-fourth of one percent sales and
use tax for improvements to the water and wastewater systems of the
City and acquisition of water resources for the City, shall be held
in the City of Corpus Christi on November 2, 1993.
SECTION 2. That at said election herein ordered all the
qualified voters of the City of Corpus Christi shall be permitted
to vote.
SECTION 3. That voting machines shall be employed at the
election herein ordered in accordance with the Texas Election Code
and said election shall be held at the polling places in the
regularly prescribed precincts of the City of Corpus Christi, such
voting precincts and polling places being set forth on Attachment

A hereto, incorporated by reference and made part of this
ordinance. Said election shall be held in accordance with the
election laws of the State of Texas. The polls shall be open from
7:00 a.m. to 7:00 p.m. on the day of the election.
SECTION 4. The City Secretary shall conduct the election as
directed by resolution of the City Council and by law.
SECTION 5. Voting machines shall be used for the conduct of
the Election on election day and paper ballots shall be used for
conducting early voting. Early voting in person at each of the
temporary branch polling places shall be conducted from 8:00 a.m.
to 5:00 p.m., Monday through Friday, beginning on October 13, 1993,
and ending on October 27, 1993, and on October 28 and 29, 1993,
from 7:00 a.m. to 7:00 p.m. Early voting in person may be
conducted at the main early polling place located in the Nueces
County Courthouse, 901 Leopard, or at the temporary branch polling
places hereby established as follows:

SECTION 6. The proposition shall appear on the ballot as

SECTION 7. The City Secretary is directed to post and publish
such election notices as are required by the Election Laws of the
State of Texas.
SECTION 8. By approving and signing this ordinance, the Mayor
officially confirms as her action all matters recited in this
ordinance which by law come within her jurisdiction.
SECTION 9. The election shall be conducted in accordance with
any agreement between Nueces County and the City of Corpus Christi
to hold a joint election on November 2, 1993, and the City
Secretary is authorized to approve all lawful changes and additions
to the procedures provided herein in order to implement such
agreement, including but not limited to provisions for mobile
voting.

SECTION 10. If for any reason any section, paragraph,
subdivision, clause, phrase, word, or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word, or provision
of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its
purpose.
SECTION 11. That upon written request of the Mayor or five
Council members, copy attached, to find and declare an emergency
due to the need for immediate action necessary for the efficient
and effective administration of City affairs, such finding of an
emergency is made and declared requiring suspension of the Charter
rule as to consideration and voting upon ordinances at two regular
meetings so that this ordinance is passed and shall ake effect
