HomeMy WebLinkAbout021751 RES - 09/28/1993RESOLUTION AUTHORIZING THE CITY MANAGER TO TARE THOSE ACTIONS REQUIRED TO OBTAIN CERTIFICATION TO ALLOW THE CITY TO REGULATE RATES CHARGED BY TCI CABLEVISION OF TEXAS, INC. FOR BASIC CABLE SERVICE AND EQUIPMENT; AND MAKING FINDINGS RELATED TO THE CERTIFICATION PROCESS. WHEREAS, the Cable Television Consumer Protection and Competition Act, enacted by the United States Congress in October 1992, authorizes the City of Corpus Christi to regulate the rates charged by TCI Cablevision of Texas, Inc. ("TCI") for basic cable service and equipment if the City obtains certification from the Federal Communications Commission; and WHEREAS, the City Council desires that the City Manager take those actions required to obtain the certification from the Federal Communications Commission ("FCC"); NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. TCI is franchisee under a franchise granted by the City which allows TCI to provide cable television service in the city. Under federal regulations, TCI is presumed not to be subject to effective competition. The City Council has reason to believe that this presumption is correct and an initial finding of lack of effective competition is hereby made. SECTION 2. Within 120 days of certification, the City intends to adopt and begin to administer regulations with respect to basic cable service that are consistent with the regulations adopted by the FCC pursuant to 47 U.S.C. § 543(b). SECTION 3. The City Council intends to adopt regulations applicable to rate regulation proceedings which will provide a reasonable opportunity for consideration of the views of interested parties. SECTION 4. The City Manager is authorized and directed to take all actions necessary to apply for and obtain certification from the FCC to allow the City to regulate rates charged by TCI for basic cable service and equipment. SECTION 5. That the City Secretary is instructed to send a copy of this resolution to TCI's General Manager Dennis Moore and TCI's Area Manager Randy Grimes.
