AUTHORIZING THE CITY MANAGER TO OBJECT TO RATES FOR CABLE
PROGRAMMING SERVICE (EXPANDED BASIC SERVICE) OR
ASSOCIATED EQUIPMENT, OR RATE INCREASER FOR SUCH SERVICE
OR EQUIPMENT, WHICH MAY BE CHARGED BY CABLE OPERATORS IN
THE CITY FROM TIME TO TIME.
WHEREAS, the Cable Television Consumer Protection and
Competition Act, enacted by the United States Congress in October
1992, authorizes the City of Corpus Christi to object to the
reasonableness of rates charged for cable programming service or
associated equipment, or to rate increases for such service or
associated equipment; and
WHEREAS, the City Council desires that actions be taken from
time to time as necessary to obtain Federal Communications
Commission ("FCC") review of such rates or rate increases;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI:
SECTION 1. The City Manager is authorized and directed to
monitor the rates charged by cable operators in the city for cable
programming service (expanded basic service) or associated
equipment. The City Manager is also authorized and directed to
take all actions necessary or appropriate to object to such rates
or rate increases. Such actions may include filing complaints with
the FCC to cause FCC review of such rates or rate increases. The
City Manager is authorized to take actions authorized in this
resolution from time to time, as he deems appropriate, to object to
unreasonable rates.
SECTION 2. That the City Secretary is instructed to send a
copy of this resolution to TCI's General Manager Dennis Moore and
TCI's Area Manager Randy Grimes.
