CLOSING AND ABANDONING A 5.53 SQUARE FOOT PORTION OF THE
CHAPARRAL STREET RIGHT-OF-WAY ABUTTING LOT 3, BLOCK 12,
BEACH PORTION (50.2 FEET LONG AND VARYING IN WIDTH FROM
0.07 FEET TO 0.15 FEET) AND A 92.55 SQUARE FOOT PORTION
OF THE MESQUITE STREET RIGHT-OF-WAY ADJACENT TO LOTS 10,
11, AND 12, BLOCK 12, BEACH PORTION (40.36 FEET LONG BY
1.75 FEET WIDE AND 109.62 FEET LONG BY 0.20 FEET WIDE),
SUBJECT TO APPLICANT REPLATTING THE PROPERTY WITHIN 180
DAYS; AND DECLARING AN EMERGENCY.
WHEREAS, there exists a 5.53 Square foot portion of the
Chaparral Street right-of-way abutting Lot 3, Block 12, Beach
Portion (50.2 feet long and varying in width from 0.07 feet to 0.15
feet) and a 92.55 square foot portion of the Mesquite Street right-
of-way adjacent to Lots 10, 11, and 12, Block 12, Beach Portion
(40.36 Feet long by 1.75 feet wide and 109.62 feet long by 0.20
feet wide), as shown by plat recorded in Volume A, Pages 2 and 3,
Map Records, Nueces County, Texas;
WHEREAS, it has been determined that it is feasible and
advantageous to the City of Corpus Christi to abandon said
easement, subject to the provisions listed below;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI:
SECTION 1. That a 5.53 Square foot portion of the
Chaparral Street right-of-way abutting Lot 3, Block 12, Beach
Portion (50.2 feet long and varying in width from 0.07 feet to 0.15
feet) and an 92.55 square foot portion of the Mesquite Street
right-of-way adjacent to Lots 10, 11, and 12, Block 12, Beach
Portion (40.36 feet long by 1.75 feet wide and 109.62 feet long by
0.20 feet wide), as shown by plat recorded in Volume A, Pages 2 and
3, Map Records, Nueces County, Texas, as shown on Exhibit "A", be
and the same is hereby closed for public use and every municipal
purpose, subject to the property being replatted at owner's expense
within 180 days after passage of this ordinance, provided however,
the City Engineer may extend the time limit for an additional one
hundred eighty (180) days if circumstances outside the owner's
control necessitate an extension.
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word or provision
of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase,

word or provision hereof be given full force and effect for its
purpose.
SECTION 3. That upon written request of the Mayor or
five Council members, copy attached, to find and declare an
emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such
finding of an emergency is made and declared requiring suspension
of the Charter rule as to consideration and voting upon ordinances
at two regular meetings so that this ordinance is passed and shall
take effect upon first eading as an emergency measure this the

BEACH PORTION -TRACT 1
Description for an irregularly shaped tract of land out of that
portion of Mesquite Street that lies west of and adjacent to
Lots 12, 11, 10, and 9, Block 12, Beach Portion, a subdivision
of the City of Corpus Christi, Texas recorded in Volume A, Page
3, Nueces County, Texas Map Records, said tract of land being
more particularly described by metes and bounds as follows;
Beginning at a point in the east right of way line of said
Mesquite Street, the west boundary line of said Lot 12, for
the southeast and beginning corner of the tract herein described,
from whence the southwest corner of said Lot 12, bears South -
16° -12' -00" -West, a distance of 1.62 feet;
Thence North -73° -48' -00" -West, along the face of a multi -story
masonry building, a distance of 1.75 feet to a point, the
southwest corner of said building, for the southwest corner
of the tract herein described;
Thence North -16° -12' -00" -East, along the face of said multi-
story masonry building, a distance of 40.36 feet to a point,
a corner of said building, and for a corner of the tract herein
described;
Thence South -73° -43' -00" -East, along the face of said masonry
building, a distance of 1.50 feet to a point, an interior corner
of said building, for an interior corner of the tract herein
described;
Thence North -16° -12' -00" -East, with a line that is 0.20 feet
west of and parallel to the west line of said Lots 12, 11, 10,
and 9, and along the face of said masonry building, a distance
of 109.62 feet to a point the northwest corner of said building,
for the northwest corner of the tract herein described;
Thence South -73° -48' -00" -East, with the face of said masonry
building, a distance of 0.20 feet to a point in the west boundary
line of said Lot 9, the east right of way line of said Mesquite
Street, for the northeast corner of the tract herein described;
Thence South -16° -12' -00" -West, with the west boundary line of
said Lots 9, 10, 11, and 12, a distance of 149.98 feet to the
point of beginning.
Containing 92.55 square feet of land.

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter
rule as to consideration and voting upon ordinances at two regular
meetings: I/we, therefore, request that you suspend said Charter
rule and pass this ordinance finally on the date it is introduced,
or at the present meeting of the City Council.
