HomeMy WebLinkAbout021791 ORD - 11/16/1993AN ORDINANCE CLOSING AND ABANDONING THE EASTERLY ONE-HALF (OR EAST 20 FEET) OF COUNTY ROAD 19 RIGHT-OF-WAY EXTENDING FROM THE SOUTHERN BOUNDARY OF WEBER'S GLEN SUBDIVISION SOUTHWEST TO THE SCHANEN DRAINAGE EASEMENT; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists the easterly one-half (or east 20 feet) of County Road 19 right-of-way extending from the southern boundary of Weber's Glen Subdivision southwest to the Schanen Drainage easement, by plat recorded in Volume 49, Pages 165-167 of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That the easterly one-half (or east 20 feet) of County Road 19 right-of- way extending from the southern boundary of Weber's Glen Subdivision southwest to the Schanen Drainage easement, as shown by plat recorded in Volume 49, Pages 165-167, of the Map Records, Nueces County, Texas, as shown on Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to specified conditions as part of closure: 1) Dedicate 9,413 -square foot long utility easement along the west property line of Sun Valley Estates residential subdivision. AG5000.433.ajr 2) Dedicate an easement for the buried cable in the right-of-way currently only serving a residence south of Schanen Drainage Channel. 3) Replat all properties owned by the property owner adjacent to this proposed street closure, at owner's expense. 4) No fair market value is to be required. In lieu of fair market value the dedication of all proposed street right-of-way throughout the Sun Valley Estates Subdivision will be required. 0 :1791 1 311f1LMEOE 2 SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take of ect upon first reading as an emergency measure this the (to day of F; (Art vrbt r� , 19 03 .
