HomeMy WebLinkAbout021793 ORD - 11/16/1993AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY WHITTLE & ASSOCIATES, P.C., BY CHANGING THE ZONING MAP IN REFERENCE TO A 6.02 ACRE TRACT OF LAND OUT OF LOTS 10 AND 11, SECTION 11, FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, FROM "A-1" APARTMENT HOUSE DISTRICT TO "R -1B" ONE - FAMILY DWELLING DISTRICT; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its report and recommendations concerning the application by Whittle & Associates, P.C. for amendment to the zoning map of the City of Corpus Christi. WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, October 20, 1993, during a meeting of the Planning Commission and on Tuesday, November 16, 1993, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth adoption would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning of a 6.02 acre tract of land out of Lots 10 and 11, Section 11, Flour Bluff and Encinal Farm and Garden Tracts, located at the terminus of New Bedford Drive, north of Brockhampton Street, be cahnged from "A-1" Apartment House District to 'R -1B" One -family Dwelling District. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That all ordinances or parts of ordinances in conflict herewith are 93NH2889.054.ak 1093-2 021793 2 hereby expressly repealed. SECTION 6. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION S. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is pasKd and shall take effect upon first reading as an emergency measure this the ((a day of NO rf im e (; 1993. Brighton Village Unit 4, a map of which is recorded in Volume 49, Pages 117 thru 119 of said Map Records, for the West corner of this tract; THENCE N 28 55,05" E, along the common boundary of Lots 11 and 12, said Section 11, a distance of 300.00 feet for the North corner of this tract; Thence S 61 02'30" E 874.72 feet for the East corner of this tract; Thence S 28 57'30" W 300.00 feet for the North corner of Block 1, Brighton Village Unit 3, a map of which is recorded in Volume 49, Pages 79 and 80 of said Map Records, and for the South corner of this tract; Thence N 61 02'30" W, at 60.00 feet pass the East corner Lot 56, Block 11, said Brighton Village Unit 3, at 160.00 feet pass the North Corner of said Lot 56 and the East corner of Lot 12, Block 11, said Brighton Village Unit 4, in all a distance of 874.51 feet for the POINT OF BEGINNING.
