HomeMy WebLinkAbout021806 ORD - 11/23/1993AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY SOUTH TEXAS LIGHTHOUSE FOR THE BLIND BY GRANTING A SPECIAL COUNCIL PERMIT FOR A PARKING LOT ON HILLSIDE ADDITION, BLOCK 2, LOTS 1 THROUGH 7, SUBJECT TO FOUR (4) CONDITIONS; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of South Texas Lighthouse for the Blind for amendment to the zoning map of the City of Corpus Christi; WHFREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, October 20, 1993, during a meeting of the Planning Commission and on Tuesday, November 23, 1993, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That a Special Council Permit be granted for a parking lot on Hillside Addition, Block 2, Lots 1 through 7, located on the north side of Mestina Street, between Coke Street and Crosstown Expressway, subject to (4) conditions: 1. USE: The only use authorized by this Special Council Permit other than the basic "A-2" Apartment House District uses, is a parking lot limited to employees and visitors of the South Texas Lighthouse for the Blind. The parking lot may not be used at any time day or night by tractors, trailers, trucks, buses, or other commercial vehicles. 2. SCREENING: A screening fence six (6) feet in height from the natural ground capable of withstanding a thirty (30) pound per square foot wind load, and which shall constitute a visual obstruction, must be installed along the Mestina Street 93NH2889.062.ak 1093-1 021806 2 frontage with sufficient setback for landscaping except that the screening fence must be setback fifty (50) feet from the west right-of-way line of the Crosstown Expressway. The screening fence must be installed within one (1) year of the date of this ordinance. 3. LANDSCAPING: Landscaping, as required by the Landscaping Ordinance along Mestina Street must be located between the screening fence and the north right-of- way line of Mestina Street. All landscaping must be installed within one (1) year of the date of this ordinance. 4. LIGHTING: All on-site lighting must be directed so that the light and glare emanating therefrom is not cast upon residential property to the annoyance or inconvenience of persons of normal sensibility residing on or upon such residential property. SECTION 3. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Council Permit herein granted, other than the use specified in this Special Council Permit, this Special Council Permit shall be void and of no force and effect whatsoever. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. SECTION 7. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 8. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 9. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting 93NH2889.062.ak 1093-1 3 upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 24' day of bJOve m1t 993.
