HomeMy WebLinkAbout021814 ORD - 12/14/1993AN ORDINANCE AMENDING SECTION 55-50, 55-61, 55-100 AND 55-148 OF THE CODE OF ORDINANCES, REGARDING WATER, GAS, AND WASTEWATER RATES; PROVIDING FOR REPEAL OF ALL ORDINANCES IN CONFLICT; PROVIDING FOR SEVERABILITY; PROVIDING FOR AN EFFECTIVE DATE; AND PROVIDING FOR PUBLICATION. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That rates for utility service provided by the City of Corpus Christi be and the same are hereby amended as follows: (a) That City Rates and the City rates for Domestic, Code, Chapter 55, Utilities, Article III, Water Charges, Section 55-50, Schedule, on file with Secretary, is hereby amended by changing the Untreated Water - Industrial, Municipal, and to hereafter read as follows: Commodity Charge For all water consumed "Annual Calculated Basic Cost" (b) Section 55-50, Code of Ordinances, City of Corpus Christi (Water Rates): All rates in this section, as on file with the City Secretary, are hereby increased by six percent (6%). (c) That City Code, Chapter 55, Rates and Charges, Section customers and schedules f follows: ows: Utilities, Article IV. Gas 55-61. Classification of u es o rates shall be amended as The classification of customers and schedules of rates shall be on file with the City Secretary. The classification of customers and schedule of rates is hereby deleted from the Code of Ordinances. (d) Section 55-61, Code of Ordinances, City of Corpus Christi (Gas Rates): All rates in this section, as on file with the City Secretary, are hereby increased by six percent (6%). Schedule shall be amended as follows: (f) (g) The Schedule shall be on file with the City Secretary. The Schedule is hereby deleted from the Code of Ordinances. Section 55-100, Code of Ordinances, City of Corpus Christi (Sewer Rates): All rates in this section, including the adjusted wastewater winter averaging rate set out in Sec. 55-100, all of which are on file with the City Secretary, are hereby increased by six percent (6%). That City Code, Chapter 55, Utilities, Article XI. Commercial and Industrial Waste Disposal and Pretreatment, Section 55-148 (a)(8) be amended as follows: (8) The city shall adopt, by separate ordinancc, abnormal wastewater surcharge fees based upon the foregoing formula. Said fees shall be on file with the City Secretary. (h) That the Abnormal Wastewater Surcharge Rates, established by Ordinance No. 20895, adopted by City Council on March 20, 1990, are hereby increased by six percent (6%). SECTION 2. That all ordinances and parts of ordinances in conflict herewith be and the same are hereby repealed to the extent of such conflict. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. The rates established in Section 1 of this ordinance shall take effect.and be applied against all service provided on or after January 1, 1994, which is billed in a utility reading cycle which includes only service provided on or after January 1, 1994. PURCHASED GAS ADJUSTMENT. These rates are subject to gas cost adjustments as follows: Rates will be adjusted monthly by the City following the receipt of notice of the cost of gas from the supplier to pass on to the consumer the full amount of such cost adjusted for pressure base and gas loss and unaccounted-for factors. All General customers who consume over 15,000 MCF in one month and who receive gas from the City's distribution system at the same pressure which the City receives the gas from it's supplier (14.65 psi) shall be billed 2.05% less per MCF for purchased gas adjustment than the General Customer Rate Schedule. 0031 SECTION 4. INTERRUPTIONS. Deliveries of gas to commercial or industrial customers may be interrupted or curtailed in case of shortage, or threatened shortage, of gas supply from any cause whatsoever, to conserve gas for residential and other human need customers served hereunder, according to all mandatory orders of governmental agencies having jurisdiction. 0032 Class Sec. 55-100. This supplemental charge will be calculated by dividing the total actual monthly expenditures for well drilling (amortized over four years), pumping, and land leases, plus other water supply development costs, by the actual water withdrawn for the month to provide a cost per 1,000 gallons to be billed to each raw water customer to their use.
