HomeMy WebLinkAbout021815 RES - 12/14/1993A RESOLUTION EXPRESSING THE INTENT OF THE CITY COUNCIL TO ESTABLISH A DRAINAGE UTILITY AND PURSUE OTHER POTENTIAL FUNDING MECHANISMS TO PAY COSTS ASSOCIATED WITH THE WATER DELIVERY AND CONVEYANCE CONTRACT WITH THE LAVACA-NAVIDAD RIVER AUTHORITY WHEREAS, on September 22, 1992, the City Council by resolution authorized acceptance of an assignment from the Port of Corpus Christi Authority of an Option Agreement to purchase water from the Lavaca-Navidad River Authority and entered into an Option Agreement to purchase water rights from the Garwood Irrigation Company; and WHEREAS, on September 14, 1993, the City Council adopted a resolution expressing the City's intent to exercise said options with the Lavaca-Navidad River Authority and Garwood Irrigation Company; and WHEREAS, on December 14, 1993, the City Council adopted a resolution authorizing the City Manager to exercise the Option Agreement with the Lavaca-Navidad River Authority by executing on behalf of the City of Corpus Christi the Water Delivery and Conveyance Contract Between Lavaca-Navidad River Authority And City of Corpus Christi, Texas; and WHEREAS, on December 14, 1993, the City Council adopted an ordinance increasing water, wastewater and gas utility rates to pay for critically necessary Capital Improvement Program projects for the water and wastewater systems of the City of Corpus Christi; and WHEREAS, the cost of acquiring the water from the Lavaca- Navidad River Authority will require the development of additional funding sources; and WHEREAS, additional time may be required to identify and develop additional funding sources for the purchase of the Garwood Irrigation Company's water rights. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS; SECTION 1. The City Manager is hereby directed to initiate the steps required under the laws of the State of Texas to establish a local drainage utility to carry out drainage activities and federally -mandated stormwater quality programs and to design a drainage utility fee for both residential and commercial properties that recovers the cost of providing drainage and stormwater quality services previously included in the Water Fund. plerpirlf 021815 SECTION 2. The City Council and City staff will vigorously pursue other potential sources of funding for new water supplies, including: a) Transferring funds and/or dedicating sales tax revenues from the Regional Transit Authority to the City for additional water supplies; b) Renegotiating the Choke Canyon federal repayment contract and undertaking a local buy-out of the reservoir project at a discounted present value; and c) Investigating the feasibility of treating the cost of water supply as a "pass-through" cost in billing for water services, similar to the current method of billing for natural gas purchases at cost. SECTION 3. The City Manager is hereby directed to seek at least a one-year extension of the water purchase option contract with Garwood Irrigation Company. SECTION 4. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this resolution shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this resolution for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
