HomeMy WebLinkAbout021819 ORD - 12/14/1993AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY WARSU, INC., BY CHANGING THE ZONING MAP IN REFERENCE TO CULLEN PLACE UNIT 5, BLOCK C, PORTIONS OF LOTS 7 AND 8 FROM "R -1B" ONE -FAMILY DWFIT,ING DISTRICT TO 'B-1" NEIGHBORHOOD BUSINESS DISTRICT; BY GRANTING A SPECIAL USE PERMIT FOR ADDITIONAL RETAIL USES ON CULLEN PLACE, BLOCKS A AND B, AND CULLEN PLACE UNIT 5, BLOCK C, PORTIONS OF LOTS 7 AND 8; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Warsu, Inc. for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, November 3, 1993, during a meeting of the Planning Commission and on Tuesday, December 14, 1993, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHFREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning of Cullen Place Unit 5, Block C, portions of Lots 7 and 8, described in Exhibit A attached hereto and made a part hereof for all purposes, located along the south side of South Alemeda Street, approximately 150 feet west of Dickens Drive, be changed from 'R -1B" One -family Dwelling District to 'B-1" Neighborhood Business District. SECTION 2. That a Special Use Permit be granted for the following uses in addition to all B-1 Neighborhood Business District uses on Cullen Place, Blocks A and B; and Cullen Place Unit 5, Block C, portions of Lots 7 and 8, located along the east side of Airline Road, between Belmeade Drive and South Alameda Street and along the south side of South Alemeda Street between Dickens Drive and Airline Road: 93NH2889.059.ak 10934 < 1d1'3 NICROamEa 2 1. USE: The only uses authorized by this Special Use Permit other than the basic 'B -P" Neighborhood Business District uses with the specific exclusion of sexually -oriented businesses, are as follows: a) Sales and repair of plumbing, heating, electrical, and air conditioning equipment, and auto parts sales and tire sales, without the installation or repair of tires, within an enclosed building; b) Wholesale house of not more than 6,000 square feet in floor area; c) Printing, publishing and engraving; d) Radio or television broadcasting stations, studios, and offices, but no sending or receiving towers; e) Swimming pool or natatorium in an enclosed building; f) Accessory buildings and uses; g) Public or governmental buildings; and h) Car washes. 2. ON -PREMISE SIGNS: All signs on the property shall be on -premise signs and must comply with the following: a) Freestanding signs must not exceed: 1) a height of thirty 30 feet, 2) four (4) in number, and 3) total sign area of 281 square feet. b) No freestanding sign may be located any closer than 150 feet from the north right- of-way line of Belmeade Drive or closer than 330 feet from the east right-of-way line of Dickens Drive; c) Wall signs are permitted in addition to the freestanding signs with no limitation in regard to size and number; d) Wall signs must be attached flat against the wall of the building, shall not project more than eighteen (18) inches from the wall of the building or structure and shall not project above the height of the building; 93N112889.059.ak 10934 3 e)Signs shall not utilize or incorporate flashing, moving, or intermittent illumination; t) Portable signs are prohibited; and If at the intersection of Airline Road and South Alameda Street a corner lot is platted, such lot shall be individually allowed the standard 'B-1" District sign allowances. SECTION 3. In the event the Board of Adjustment grants any special exception or variance to the Zoning Ordinance, applicable to the Special Permit herein granted, other than the one specified in this Special Permit, said Special Permit shall be void and of no force and effect whatsoever. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 8. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 9. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the day of , 1993. 93NH2889.059.ak 1093-4 ATTEST: APPROVED THIS THE 22ND DAY OF NOVEMBER 1993 JAMES R.
