HomeMy WebLinkAbout021829 RES - 12/21/1993RESOLUTION AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE CITIES OF ARLINGTON, AUSTIN, DALLAS, EL PASO, FORT WORTH, HOUSTON, AND SAN ANTONIO TO JOINTLY EMPLOY A PERSON TO COORDINATE THE LEGISLATIVE PACKAGE FOR SAFETY, CRIME, AND LAW ENFORCEMENT FOR THE 74TH REGULAR LEGISLATIVE SESSION. WHEREAS, the City of Corpus Christi's Mayor is a member of Mayors United on Safety, Crime, and Law Enforcement (MUSCLE); and WHEREAS, the members of MUSCLE wish their cities to present a collective safety, crime, and law enforcement legislative package during the 74th Regular Legislative Session; and WHEREAS, cooperation and coordination among the members of MUSCLE and their respective city staffs is necessary to effectively formulate and present a collective safety, crime, and law enforcement legislative package; NOW, THEREFORE, BE OR RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is hereby authorized to execute an Interlocal Agreement with the cities of Arlington, Austin, Dallas, El Paso, Fort Worth, Houston, and San Antonio to jointly employ a person to coordinate the legislative package for safety, crime, and law enforcement for the 74th Regular Legislative Session, a substantial copy of which is attached hereto and made a part hereof marked Exhibit "A". SECTION 2. That the City Manager, or his designee, is authorized to contribute $2,507.81 by December 31, 1993 to the City of Austin to pay for the joint employee. WHEREAS, the Mayors United on Safety, Crime and Law Enforcement (MUSCLE) was formed as an alliance of Texas urban cities to reduce crime; and WHEREAS, the members of MUSCLE wish their cities to present a collective safety, crime and law enforcement legislative package during the 74th Regular Legislative Session; and WHEREAS, cooperation between the parties to this Agreement is necessary in order to effectively formulate and present a legislative package for safety, crime, and law enforcement, NOW, THEREFORE, THE PARTIES TO THIS AGREEMENT AGREE AS FOLLOWS: 1. Purpose. The purpose of this Agreement is to allow the parties to coordinate the formulation and presentation of a legislative package for safety, crime, and law enforcement for the 74th Regular Legislative Session. 2. City of Austin Responsibilities. a. The City of Austin will employ one full-time staff person to provide administrative services related to a safety, crime, and law enforcement legislative package for the parties. The staff person's duties will include scheduling meetings with state officials, preparing research documents and legislation presentation materials, organizing a legislative conference, and maintaining all scheduling and calendar activities. The staff person will provide monthly reports of activities to all parties. b. The anticipated expenditure of funds is set out in Exhibit "A" to this Agreement, which is hereby incorporated by reference and made a part hereof for all purposes. 3. Allocation of Costs. In consideration for this Agree- ment, the parties agree to contribute a nonrefundable allocated amount to the City of Austin for performance of this Agreement by December 31, 1993, for a total budget cost of $53,776.00, as follows: Arlington $ 2,549.18 Austin 4,535.19 Corpus Christi 2,507.81 Dallas 9,807.04 El Paso 5,019.46 Ft. Worth 4,359.93 Houston 15,881.65 San Antonio 9,116.04 1I:f l The budget allocation is based upon the population of each party by 1990 Federal Census. All payments by parties shall be from current available revenue funds. 4. Term of Agreement. This Agreement shall be effective on January 1, 1994, and shall remain in effect for one (1) year. 5. Termination. Any party may, upon written notice to all other parties, withdraw from this Agreement at any time, but shall not be entitled to a refund of the amount paid to the City of Austin. 6. The parties to this Agreement shall provide all services and activities required by this Agreement in compliance with the Americans with Disabilities Act of 1990. The parties shall not discriminate against any person based on race, religion, color, sex, national origin, age, or disability. 8. Amendment. Any change to the provisions of this Agree- ment or any attachments to it shall be made by mutual agreement of the parties hereto, in writing, and signed by all parties. 9. Legal Authority. The persons signing this Agreement on behalf of each party do hereby warrant and guarantee that they have been duly authorized by their City to sign this Agreement on behalf of the City and to bind the City validly and legally to all terms, performances, and provisions in this Agreement. 10. Law and Venue. This Agreement is governed by the laws of the State of Texas and venue for any litigation concerning this Agreement shall be in the City of Austin, Texas. 11. Leaal Construction. In case any one or more of the provisions contained in this Agreement shall be held to be invalid, illegal or unenforceable in any respect, such inva- lidity, illegality, or unenforceability shall not affect any other provision thereof and the Agreement shall be construed as if such invalid, illegal, or unenforceable provision had not been contained herein. 12. Entire Agreement. All oral and written agreements among the parties to this Agreement relating to the subject matter of this Agreement that were made prior to the execution of this Agreement have been reduced to writing and are contained in this Agreement. Any agreement, covenant, or understanding that is not included in this document has been superseded by this Agreement.
