AMENDING THE CODE OF ORDINANCES, CHAPTER 21, GARBAGE,
TRASH AND OTHER REFUSE, BY ADDING A NEW SECTION 21-20
ESTABLISHING A SURCHARGE FOR STATE/FEDERAL MANDATED
COSTS; PROVIDING FOR SEVERANCE; AND PROVIDING FOR
PUBLICATION; AND DECLARING AN EMERGENCY.
WHEREAS, the Texas Natural Resources Conservation
Commission has mandated that recompacted clay and plastic liners be
constructed for municipal solid waste landfills; and,
WHEREAS, based on current bid prices for these liners,
the City of Corpus Christi will be required to spend $1.1 million
every year; and,
WHEREAS, these costs are directly attributable to the
mandates of the Texas Natural Resources Conservation Commission;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CORPUS CHRISTI, TEXAS:
SECTION 1. That the Code of Ordinances, Chapter 21,
Trash and Other Refuse, is hereby amended by adding a new
21-20 to read as follows:

Section 21-10. Surcharge for State/Federal mandated
costs.
The following surcharges shall be added to the charges
established in sections 21-18 and 21-19 above:
For the collecting and disposal of garbage, trash and
debris from residential and apartment properties, and
from business and commercial institutions and all other
occupied premises, for which the collection services of
the department of solid waste services are provided:
Surcharge for State/Federal Mandated
costs, per month or fraction thereof
For disposal of solid waste and rubbish at any City
disposal site designated by the director of solid waste
services, for which a charge per ton or cubic yard is
required to be paid:
Surcharge for State/Federal Mandated
costs, per ton or fraction thereof
Surcharge for State/Federal mandated
costs, per cubic yard or fraction
thereof, it scales are not available:

SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgment of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word or provision
of this ordinance for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase,
word or provision hereof be given full force and effect for its
purpose.
SECTION 3. Publication shall be made in the official
publication of the City of Corpus Christi as required by the City
Charter of the City of Corpus Christi.
SECTION 4. That upon written request of the Mayor or
five Council members, copy attached, to find and declare an
emergency due to the need for immediate action necessary for the
efficient and effective administration of City affairs, such
finding of an emergency is made and declared requiring suspension
of the Charter rule as to consideration and voting upon ordinances
at two regular meetings so that this ordinance is passed and shall
take effect upon first reading as an emergency Neasure this the
