HomeMy WebLinkAbout021860 ORD - 01/25/1994AN ORDINANCE CLOSING AND ABANDONING A 60 -FOOT WIDE BY 35 -FOOT LONG PORTION OF NELSON DRIVE RIGHT-OF-WAY ADJACENT TO LOT 10, BLOCK 1, MOORE PLAZA; SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 60 -foot by 35 -foot long portion of Nelson Drive right-of-way adjacent to Lot 10, Block 1, Moore Plaza, by plat recorded in Volume 55, Pages 121 and 122, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 60 -foot wide by 35 -foot long portion of Nelson Drive right-of-way adjacent to Lot 10, Block 1, Moore Plaza as shown by plat recorded in Volume 55, Pages 121 and 122, of the Map Records, Nueces County, Texas, as shown on Exhibit "A," be and the same is hereby closed for public use and every municipal purpose, subject to specified conditions as part of closure: 1. Dedicate the area as a utility easement. 2. That the properties be replatted with notation on the replat stating "Physical access to Nelson Drive not allowed by the City of Corpus Christi without a specific amendment to plat" be retained on any replat. 3. Payment of Fair Market Value by the owner totalling $4,200. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as n emergency measure this the 25 day of `jcinAAOG Wj , 19 um ATTEST: Ci y Secretary MAYOR APPROVED: 19 DAY OFOttiku_tt.sit)JR.CI JAMES R.
