HomeMy WebLinkAbout021895 ORD - 03/15/1994AN ORDINANCE CLOSING AND ABANDONING PORTIONS OF 10 -FOOT WIDE UTILITY EASEMENTS IN BLOCK C, LEVEK TRACT, TOTALLING 11,850.975 SQUARE FEET; SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS, AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10 -foot wide utility easement located in Block C, Levek Tract, by plat recorded in Volume 35, Page 90 of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 10 -foot wide utility easement in Block C, Levek Tract as shown by plat recorded in Volume 35, Page 90, of the Map Records, Nueces County, Texas, as shown on Exhibit "A," be and the same is hereby closed for public use and every municipal purpose, subject to compliance with specified conditions as part of closure: 1) The property being replatted at owner's expense within 180 days of passage of this ordinance; provided, however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the applicant's control necessitate an extension. 2) The dedication of a new utility easement equal in area in lieu of the fair market value. AG5000.492abf 3) The relocation of city utility lines and Southwestern Bell facilities at owner's expense. 4) Relocation of sanitary sewer lines serving Block B, and Lot 2, Block D, and relocation of water line that serves to meet the fire protection requirements at owner's expense.
