HomeMy WebLinkAbout021907 RES - 03/29/1994A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE UTILITY SYSTEM REVENUE BONDS, SERIES 1994; AND RESOLVING OTHER MATTERS RELATING TO THE SUBJECT WHEREAS, it is hereby officially found and determined that a meeting at which this Resolution is to be considered is required as soon as possible and without delay for the immediate and efficient utilization of physical resources in the city and for the efficient and effective administration of the City's affairs; and that said meeting was open to the public, and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code, as amended. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That attached hereto and marked "Exhibit A" is a form of notice, the form and substance of which are hereby passed and approved. Section 2. That the City Secretary shall cause said notice to be published, in substantially the form attached hereto, in the Corpus Christi Caller -Times, a newspaper of general circulation in the City, for two consecutive weeks, the date of the first publication to be before the fourteenth day before the day tentatively proposed for authorizing the issuance of the Revenue Bonds as shown in said notice. Section 3. That the City Manager, the Director of Finance, and all other appropriate officers of the City are hereby authorized to execute such documents and certificates necessary to evidence the intent of the City to reimburse expenditures for such projects to be financed from the proceeds of the proposed Revenue Bonds. Section 4. That all ordinances and resolutions or parts thereof in conflict herewith are hereby repealed. PASSED AND APPROVED this the 29th day of March, 1994. City Secretary, City of Corpus Christi, Texas Mayor,`Cirpus Christi, Texas 021907 bongo The foregoing Resolution was approved prior to passage as to form and correctness this the 2jith day of March, 1994. ) City orney, City o Corpus Christi, Texas EXHIBIT A NOTICE OF INTENTION TO ISSUE UTILITY SYSTEM REVENUE BONDS NOTICE IS HEREBY GIVEN that it is the intention of the City Council of the City of Corpus Christi, Texas, to issue the interest bearing revenue bonds of the City entitled "City of Corpus Christi, Texas Utility System Revenue Bonds, Series 1994", for the purpose of financing the costs of extending and improving the waterworks system component of the City's combined Utility System. The City Council tentatively proposes to authorize the issuance of said Revenue Bonds at its regular meeting place in the City Hall at a meeting to commence at 2 o'clock, p.m., on the 26th day of April, 1994. The maximum amount of Revenue Bonds indebtedness that may be authorized for such purpose is $11,140,000. The interest rate or rates to be borne by said Revenue Bonds shall not result in the "net effective interest rate" on said Revenue Bonds exceeding the maximum rate permitted by Texas law. The City Council shall provide for payment of such Revenue Bonds from the Pledged Revenues derived from the operation of the City's Utility System. The City Council of said City convened in REGULAR MEETING ON THE 29TH DAY OF MARCH, 1994, at the designated meeting place, and the roll was called of the duly constituted officers and members of said City Council, to -wit: Mary Rhodes, Mayor Dr. David McNichols, Mayor Pro -Tem Betty Jean Longoria, Cezar Galindo, David Noyola, Councilmembers Melody Cooper, Edward A. Martin, .• Clif Moss, Dr. Jack Best, Juan Garza City Manager Armando Chapa City Secretary and all of said persons were present, except the following absentees: , thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CITY OF CORPUS CHRISTI, TEXAS UTILITY SYSTEM REVENUE BONDS, SERIES 1994; AND RESOLVING OTHER MATTERS RELATING THERETO was duly introduced for the consideration of said City Council and read in full. It was then duly moved and seconded that said Resolution be passed; and, after due discussion, said motion carrying with it the passage of said Resolution, prevailed and carried by the following vote: AYES: All members of said City Council shown present above voted "Aye". NAYS: None. T 2. That a true, full and correct copy of the aforesaid Resolution passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Resolution has been duly recorded in said City Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt from said City Council's minutes of said Meeting pertaining to the passage of said Resolution; that the persons named in the above and foregoing paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Resolution would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code, as amended. 3. That the Mayor of said City has approved, and hereby approves, the aforesaid Resolution; that the Mayor and the City Secretary of said City have duly signed said Resolution; and that the Mayor and the City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Resolution for all purposes.
