HomeMy WebLinkAbout021911 ORD - 04/05/1994AN ORDINANCE CLOSING AND ABANDONING THE 13.72 -FOOT WIDE BY 159.62 -FOOT LONG PORTION OF SAM RANKIN STREET RIGHT-OF-WAY EXTENDING NORTH OF MARTIN LUTHER KING (I.H. 37); SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 13.72 -foot wide by 159.62 -foot long portion of Sam Rankin Street right-of-way extending north of Martin Luther King (I.H. 37), by plat recorded in Volume 56, Page 13, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 13.72 -foot wide by 159.62 -foot long portion of Sam Rankin Street right-of-way extending north of Martin Luther King (I.H. 37), as shown by plat recorded in Volume 56, Page 13, of the Map Records, Nueces County, Texas, as shown on Exhibit "A,' be and the same is hereby closed for public use and every municipal purpose, subject to specified conditions as part of closure: 1. The property being replatted at owner's expense within 180 days of passage of this ordinance; provided, however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the applicant's control necessitate an extension. 2. Retention of a 10 -foot wide by 159.62 -foot long utility easement and a 5 -foot wide by 13.72 -foot long utility easement to be shown on the replat. 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed, and shall take effect u on first reading as an emergency measure this the 'j day of '11,9I1,L( ,19(/ ATTEST: City ecretary APPROVED: 028 DAY OF ma -ch , 19"H JAMES R.
