HomeMy WebLinkAbout021914 ORD - 04/19/1994AN ORDINANCE ANNEXING A 13.46 ACRE TRACT OF LAND PLATTED AS WOOD RIVER UNIT 10 OUT OF A 205.80 ACRE TRACT CONVEYED BY BESS L. HURD ET VIR TO NINA G. STEWART IN THE MARIANO LOPEZ DE HERRERA GRANT, ABSTRACT 606 NUECES COUNTY, TEXAS, RECORDED IN VOLUME 55 PAGE 172 AND 173 NUECES COUNTY PLAT RECORDS, NUECES COUNTY, TEXAS. WHEREAS, the City of Corpus Christi desires to annex said territory to the City of Corpus Christi; and WHEREAS, on March 9, 1994, and March 15, 1994, public hearings were duly held following publication of due notice of said hearing in the official newspaper, pursuant to V.T.C.A., Local Government Code § 43.052, as amended, for the consideration of institution of proceedings for the annexation of defined area wholly within the extraterritorial jurisdiction of the City of Corpus Christi, at which all interested persons were afforded an opportunity to be heard; WHEREAS, it has been determined by the City Council that the territory within said tract or parcel of land, now proposed to be annexed, abuts and is contiguous and adjacent to the City of Corpus Christi and constitutes lands and territories subject to annexation as provided by the City Charter Article I, Section 2; and WHEREAS, it has been determined that it would be advantageous to the City and to its citizens and in the public interest to annex the aforesaid lands and territory hereinafter described: NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the tract or parcel of land as set forth in "Exhibit A" attached, is hereby annexed, said parcel or tract being described in said Exhibit A which is attached hereto and by this reference incorporated herein for all purposes, as though fully set forth herein, marked "Exhibit A". SECTION 2. That there is hereby approved as part of this ordinance a service plan attached hereto and made a part hereof for all purposes as "Exhibit B" which was made available for public inspection and explained at public hearings on March 3, 1994 and March 15, 1994. The service plan provides for the same number of services and levels of service for the annexed area to the same extent that such services are in existence in the area annexed immediately preceding the date of annexation or that are otherwise available in other parts of the city with land uses and population densities similar to those contemplated or projected in the area annexed. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of the ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. \94NH\94NH2860.103 'EXHIBIT A" METES AND BOUNDS DESCRIPTION FOR A 13.46 ACRE TRACT OF LAND OUT OF A 205.80 ACRE TRACT CONVEYED BY BESS L. STEWART IN THE MARIANO LOPEZ DE HERRERA GRANT, ABSTRACT 606 NUECES COUNTY, TEXAS, BEGINNING at a 5/8 inch iron rod found on the South boundary line of Wood River Unit 9, a map of which is recorded in Volume 51, Pages 168 and 169 Map Records of Nueces County, Texas and being the Northeast comer of Wood River Unit 2, a map of which is recorded in Volume 45, Pages 190 thru 192 Map Records of Nueces County, Texas and being the East corner of this survey; THENCE South 46 06 45" West, with the Northwest boundary line of said Wood River Unit 2 a distance of 739.71 to a 5/8 inch iron rod found to the North boundary line of a 30 foot Exxon Pipeline Easement as recorded in Volume 608, Page 86 and amended in Volume 1659, Page 751 Deed Records of Nueces County, Texas and being the most Southeast corner of this survey; THENCE North 63 10' 20" West, with the North boundary line of said 30 foot Exxon Pipeline Easement a distance of 489.21 feet to a point for the most Southwest corner of this survey; THENCE North 32 32' 40" East, a distance of 151.72 feet to a point for corner; THENCE North 16 30' 00" East, a distance of 398.44 feet to the point of curvature of a tangent curve to the Left; THENCE in a Northerly direction along said curve to the left having a central angle of 21 24' 15", a radius of 161.81 feet, an arc length of 60.45 and a tangent length of 30.58 feet to the point of reverse curvature for a curve to the right; THENCE in a Northeasterly direction along said curve to the right having a central angle of 47 02' 27", a radius of 509.52 feet, an arc length of 418.32 feet, and a tangent length of 221.76 feet to the point of tangency; THENCE North 42 08' 12" East, a distance of 9.15 feet to a point for the most Northwest comer of this survey; THENCE South 47 51' 48" East , a distance of 210.00 feet to a point on the West right-of- way line at Pecos River Drive based on a 50 foot width; THENCE South 42 08' 12" West, with the westerly right-of-way line of said Pecos River Drive a distance of 9.15 feet to a 5/8 inch iron rod found for the point of curvature of a tangent curve to the left; THENCE in a Southwesterly direction with the West right-of-way line of said Pecos River Drive along said curve to the left having a central angle of 02 38' 10" a radius of 299.52 feet, an arc length of 13.78 feet, and a tangent length of 6.89 to a 5/8 inch iron rod found for the Southwest comer of said Wood River Unit 9; THENCE South 43 53' 15" East, with the South boundary line of said Wood River Unit 9 a distance of 710.11 feet to the POINT OF BEGINNING. HURD Et VIR TO NINA G. STEWART IN THE MARIANO LOPEZ DE HERRERA GRANT Improvements constructed include streets, curbs and gutters, water, wastewater and Gas service facilities. The City will assume maintenance of these service facilities, and any new service facilities that are constructed in the right-of-ways in accordance with City standards after inspection and acceptance by the City. Items to be provided in the service plan are as follows: 1) Public safety protection, including fire and police protection, will be provided at a comparable level of service as other parts of the City on the effective date of annexation; 2) City garbage and brush collection will begin two weeks after the effective date of annexation; 3) The City Code Enforcement activity, which includes high weeds and grass, care of premises, and abandoned or junked automobiles, will be initiated within 60 days of the effective date of annexation; 4) The City's Park and Recreation Department will assume normal park maintenance of dedicated park areas within the subdivision, that are developed in accordance with the Platting Ordinance of the City of Corpus Christi; 5) City maintenance of street lighting and street signs will commence within 60 days of the effective date of annexation or as installed and accepted by the City in accordance with the Platting Ordinance; and 6) The zoning designation for the 13.46 acre tract (Wood River Unit 10) is proceeding concurrent with the annexation proceedings.
