AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO TAKE THE
NECESSARY ACTIONS TO ESTABLISH AN IMPACT FEE FOR THE
MASTER PLAN DRAINAGE CHANNEL NO. 31 IMPROVEMENTS;
SCHEDULING A PUBLIC HEARING TO RECEIVE COMMENT ON THE
ADOPTION OF LAND USE ASSUMPTIONS AND IMPACT FEES;
APPOINTING THE PLANNING COMMISSION AS THE CAPITAL
IMPROVEMENTS ADVISORY COMMITTEE; AND APPOINTING THE
EXTRATERRITORIAL JURISDICTION REPRESENTATIVE TO THE
CAPITAL IMPROVEMENTS ADVISORY COMMITTEE.
WHEREAS, the City of Corpus Christi desires to enact impact
fees to pay the costs of constructing capital improvements for
drainage;
WHEREAS, the impact fees will be imposed on land within the
service area of Master Plan drainage Channel No. 31 generally
bounded by County Road 26, Oso Bay, Yorktown Boulevard, and South
Staples Street; and
WHEREAS, the service area is within the corporate boundaries
or extraterritorial jurisdiction of the City of Corpus Christi.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF CORPUS CHRISTI, TEXAS:
SECTION 1. The City Manager or his designee shall take the
necessary actions to establish an Impact Fee for the Master Plan
drainage Channel No. 31 improvements.
SECTION 2. A consolidated public hearing on adoption of land
use assumptions, a capital improvements plan and impact fees shall
be conducted on July 19, 1994. The City Manager or his designee
shall schedule any other public hearings required by law to receive
public comments on the adoption of a capital improvements plan and
Impact fees.
SECTION 3. The Planning Commission is hereby appointed as the
Capital Improvements Advisory Committee. The Capital Improvements
Advisory Committee shall meet, as required, at the regularly
scheduled meetings of the Planning Commission and shall:
(1) advise and assist the City Council in adopting land use
assumptions;
(2) review the capital improvements plan and file written
comments;

(3) monitor and evaluate implementation plan;
(4) file semiannual reports with respect to the progress of
the capital improvements plan and report to the City Council
any perceived inequities in implementing the plan or imposing
the impact fee; and
(5) advise the City Council of the need to update or revise
the land use assumptions, capital improvements plan, and
Impact fee.
SECTION 4. Philip Neesen is hereby appointed as the
extraterritorial jurisdiction representative of the Capital
Improvements Advisory Committee and, as such, is an ad hoc voting
member of the Planning Commission when it acts as the Capital
Improvements Advisory Committee.
