HomeMy WebLinkAbout021952 ORD - 05/31/1994ORDINANCE CLOSING AND ABANDONING A 23,207.78 -SQUARE FOOT PORTION OF A 40 -FOOT WIDE COUNTY ROAD RIGHT-OF-WAY OUT OF LOTS 26 AND 27, SECTION 6 AND LOTS 2 AND 3, SECTION 7 FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACT (CAMELOT ESTATES, UNIT 2), SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS, THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 23,207.78 -square foot portion of a 40 -foot wide county road right-of-way out of Lots 26 and 27, Section 6 and Lots 2 and 3, Section 7 Flour Bluff and Encinal Farm and Garden Tract (Camelot Estates, Unit 2), by plat recorded in Volume A, Pages 41-43, of the Map Records of Nueces County, Texas; and WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That a 23,207.78 -square foot portion of a 40 -foot wide county road right-of-way out of Lots 26 and 27, Section 6 and Lots 2 and 3, Section 7 Flour Bluff and Encinal Farm and Garden Tract (Camelot Estates, Unit 2), by plat, recorded in Volume A, Pages 41-43, of the Map Records, Nueces County, Texas, as shown on Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to specified conditions as part of closure: 1. The property being replatted at owner's expense within 180 days of passage of this ordinance; provided, however, the City Engineer may extend the time limit for an additional 180 days if extenuating circumstances outside the applicant's control necessitate an extension. 2. Street dedications within the proposed subdivision to be exchanged for the Fair Market Value of the portion of road closed herein. SECTION 2.
