SUPPORTING THE ACTION OF THE TEXAS DEPARTMENT OF TRANSPORTATION
TO EXCHANGE/SELL EXCESS RICHT-OF-WAY AT THE INTERSECTION OF US
HIGHWAY 77 AND UP RIVER ROAD SUBJECT TO THE RETENTION OF UTILITY
EASEMENTS AND DECLARING THAT THIS AREA IS NO LONGER NEEDED FOR
USE BY CITIZENS FOR ROADWAY PURPOSES.
WHEREAS, in the 1960's right-of-way was acquired for the development of US 77 to a
limited access roadway; and
WHEREAS, with the development of US Highway 77 as a limited access expressway and Up
River Road as an urban arterial, some of this right-of-way at this intersection is now
considered to be excess; and
WHEREAS, the adjacent property owners have approached the Texas Department of
Transportation to relinquish their interest in the area; and
WHEREAS, the Texas Department of Transportation has asked the City to concur in this
action in this action by passage of a resolution;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CORPUS
CHRISTI, TEXAS:
SECTION 1: That the City Council of Corpus Christi supports the action of the
Texas Department of Transportation to exchange/sell excess right-of-way at the intersection
of US Highway 77 and Up River Road subject to utility easements being retained for the
existing utilities and a future force main planned for that area, as shown on the attached
Exhibit "A" and hereby declares that this area is no longer needed for use by citizens for
public purposes.
