AMENDING SECTION 55-100 OF THE CODE OF ORDINANCES, CITY
OF CORPUS CHRISTI TO CLARIFY THE DEFINITION OF "WINTER
AVERAGING WASTEWATER CHARGE PERIOD" AND "INTERIM
AVERAGE;" TO CLARIFY THE EXPLANATION OF THE METHOD OF
CALCULATING A CUSTOMER'S BILL UTILIZING A WINTER AVERAGE
USAGE; TO SPECIFY THAT WINTER AVERAGE WASTEWATER USAGE
MAY BE CALCULATED USING METER READINGS OR ESTIMATES OF
CONSUMPTION; THAT NEW OR RELOCATING CUSTOMERS MAY REQUEST
CALCULATION OF A WINTER AVERAGE BASED ON THREE MONTHS OF
CONSUMPTION AT THE NEW ADDRESS; THAT A CUSTOMER'S WINTER
AVERAGE USAGE OR INTERIM AVERAGE USAGE MAY BE EQUITABLY
ADJUSTED ACCORDING TO CITY POLICY APPROVED BY THE CITY
MANAGER; THAT SUCH CITY POLICY SHALL BE IN WRITING AND
MAY BE AMENDED FROM TIME TO TIME BY THE CITY MANAGER OR
HIS DESIGNEE; THAT SUCH CITY POLICY, AS AMENDED, SHALL BE
ON FILE WITH THE CITY SECRETARY AND AT THE UTILITIES
BUSINESS OFFICE; TO DELETE CERTAIN REFERENCES TO 1993 IN
THE SECTION; AND PROVIDING FOR SEVERABILITY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS
CHRISTI, TEXAS:
SECTION 1. That Article VII, Section 55-100 of the Code of
Ordinances, City of Corpus Christi, be and the same is hereby
amended as follows:
(b) Effective for service received beginning with utility
reading cycles on or after June 11, 1993, monthly wastewater
charges to one -family residential customers shall be computed
on the basis of the "winter average" or the "interim average"
as set forth below:
Methods of Calculating Winter Average Billing for One -
Family Residential Customers.
(1) Definitions.
a. Winter averaging wastewater charge period -
The period of water and wastewater service
during the three (3) complete consecutive
reading periods commencing on or after
November 15 of each year. During the three
(3) complete consecutive reading periods, the
city shall establish monthly wastewater
service charges for customers based upon their
average monthly water consumption. The
customer must receive wastewater service at
one location during the three (3) consecutive
reading periods in order to establish a
"winter average" except as otherwise provided
herein.

b. Winter average - The monthly wastewater usage
established by the City of Corpus Christi
during the "winter averaging wastewater charge
period". This usage is the basis for monthly
billings for service received until June 1 of
each year. Billings for service received on
or after June 1 (Junc 11 for 1993) will
reflect wastewater usage based on the previous
"winter averaging wastewater charge period."
c. Interim average - The monthly wastewater usage
established by the city for customers who have
not established a "winter average". The
"interim average" shall be seven thousand
(7,000) gallons per month and shall be the
basis for monthly billings until a "winter
average" is established as per paragraph
(b)(1)b above.
d. Service area - The geographic region served by
the city's wastewater system.
(2) Winter average criteria.
a. "Winter average" charges shall apply to one -
family residential customers only.
b. The "winter average" shall be based on a
customer's average water consumption for three
(3) complete consecutive reading periods
commencing with the customer's first reading
period on or after November 15 of each year.
c. The following method will be used to calculate
a customer's "winter average".

Add the three (3) winter months'
water consumption to get total water
consumption.
Add the number of days in the three
(3) monthly reading cycles to get
total use days.
Divide total water consumption by
total use days to get daily usage.
Multiply daily usage amount by 91.25
(the number of days in a quarter of
a year) to get three (3) month
usage.

Divide three (3) month usage amount
by three (3) to get winter average
usage. Such winter average usage
shall be limited to a maximum of
twenty-five thousand (25,000)
gallons.
Using the winter average usage,
apply the applicable rates
established in (3) below to
calculate the "winter average",-
bhp for each month until a new
average is established (or rates are
changed).
(vii) If the City is unable to obtain a
sufficient number of actual meter
readings to calculate a winter
average, then the City may utilize
any combination of actual meter
readings and estimates of actual
consumption to calculate the winter
average.
d. New and relocating customers- adjustmcnta.
(i)
Customers new to the service area
and who have not established a
"winter average" shall be billed at
the "interim average" rate. After
establishing water consumption at a
new address for three (3) complete
consecutive reading periods, and
assuming the utility account is in
the name of the consuming customer
residing at that address, that
customer may request the calculation
of a winter average based on the
three months of established
consumption at the new address.
(ii) Customers who are relocating within
the service area and who established
a "winter average" at their previous
address shall be billed at the
"interim average" rate or their
"winter average" rate at the
previous address, whichever is less.
(iii) Customers who are relocating within
the service area and who have not

established a "winter average" at
their previous address shall be
billed at the "interim average"
rate. After establishing water
consumption at a new address for
three (3) complete consecutive
reading periods, and assuming the
utility account is in the name of
the consuming customer residing at
that address, that customer may
request the calculation of a winter
average based on the three months of
established consumption at the new
address.
When a customer experiences a
substantial increase in water or
beyond thc reasonable control of the
customer and if thc customer

before April 1, thc director of
finance or his/her designee has the
discretion to adjust thc wastewater
bill.
e. Adjustments to winter average or interim
average.
A customer's winter average usage or interim
average usage may be adjusted according to
city policy approved by the city manager.
Such city policy shall be in writing and may
be amended from time to time by the city
manager or his designee. Such policy shall
permit adiustments for circumstances
including, but not limited to water leaks or
minimal consumption during new construction.
Adjustments may also be made when a customer
has experienced unusually high water
consumption because of extraordinary
circumstances. In any case, before an
adjustment will be made, the customer shall
provide reliable information which enables
city staff to verify the facts upon which a
request for adjustment is made. Such city
policy, as amended, shall be on file with the
City Secretary and at the Utilities Business
Office.

f.e- If water conservation measures [conditions I,
II, III, or IV of Section 55-151(3) ] are in
effect during "winter averaging wastewater
charge period" a new "winter average" will not
be calculated for that year. The previous
"winter average" (plus any applicable rate
change enacted by ordinance) will be in effect
until such time that no water conservation
condition remains in effect and a new "winter
averaging wastewater charge period" is
completed. The new "winter average" will be
effective for service received beginning with
utility reading cycles on or after the June 1
following the "winter averaging wastewater
charge period".
Administrative change in rates.
a. "Base Revenues" shall be defined as the
revenues (for one -family residential
wastewater customers) proposed by the city
manager to be budgeted for the forthcoming
fiscal year, based on normal rainfall and not
including any growth in the customer base or
any anticipated rate increase. The city
manager shall report his method of calculation
of the base revenues to the City Council each
year before implementing the adjusted rate
under "c" below.
b. In order to convert to the winter averaging
system enacted herein, the city manager shall,
based upon the winter average wastewater usage
determined during the winter averaging
wastewater charge period, adjust the rate
applied to each customer's winter average or
interim average so that the adjusted rate will
produce an amount equal to the base revenues.
c. The city manager shall implement the adjusted
rate effective for service received beginning
with utility reading cycles on or after June 1
(Juno 11 for 1993). There shall be at least
one (1) full billing cycle between the
effective date of any utility rate increase
and the effective date of the adjusted rate
initiating the winter averaging program.
d. Each year after 1993, the City Manager shall
perform the calculations for base revenues and
winter averages described in subsections (a)
and (b) of this section. Adjusted rates shall
then be established for that year as provided

in subsection (c).
SECTION 2. If for any reason any section, paragraph,
subdivision, clause, phrase, word or provision of this ordinance
shall be held invalid or unconstitutional by final judgement of a
court of competent jurisdiction, it shall not affect any other
section, paragraph, subdivision, clause, phrase, word, or provision
of this ordinance, for it is the definite intent of this City
Council that every section, paragraph, subdivision, clause, phrase,
word, or provision hereof be given full force and effect for its
purpose.

The wastewater winter averaging ordinance requires the City Manager to adjust wastewater charges
for one family dwellings after each winter. When applied to the most recent actual winter average
consumption, the adjusted charges will produce the same level of revenues. The annual adjustment
process may cause either an upward or downward adjustment in charges. The magnitude and
direction of adjustments depends primarily upon changes in actual water consumption during winter
months.
This year the winter average charges which determine individual customer's wastewater bills will
decrease by approximately 6.7% due to increased water consumption. The average monthly water
consumption by one family dwellings in the City during the past winter was 443,241,000 gallons.
The previous winter's monthly consumption was 396,849,000 gallons. The number of customers
increased from 64,428 to 64,808. The average consumption per customer increased by 679 gallons
per month.
Therefore, an adjustment will be made to the charges which determine individual customer's
wastewater bills beginning with service provided June 1, so that the base revenue will be maintained.
The present charge is a minimum of $9.404 for the first 2000 gallons, plus a volume charge of
$1.899 for each additional thousand gallons. The adjusted charge will be a minimum of $8.811 and
a volume charge of $1.780/1,000 gallons for calculating the winter average amount which will show
up on wastewater bills beginning in early July.
Each customer will be sent a letter approximately a week before the bill is sent explaining the new
wastewater winter average charge for that customer.

Based upon above revenues and growth patterns, July 1996 revenues are estimated to be $1,123,829. Also,
total amount of adjustments for FY 96-97 are estimated to be $144,342.
Therefore, yearly "base revenues" are estimated to be $13,630,290 ($1,123,829/month x 12 months plus
$144,342).

Ordinance No. 021814, approved by the City Council on second reading on December 14, 1993,
provides for a 6% increase in wastewater rates effective August 1, 1996. The ordinance also
specifies that the schedule of rates shall be on file with the City Secretary. Attached for your
information and file is the rate schedule for wastewater services, presented in regular and in
legislative form to show the comparison between the present and future rates.

The wastewater winter averaging ordinance requires the City Manager to adjust wastewater charges
for one family dwellings after each winter. When applied to the most recent actual winter average
consumption, the adjusted charges will produce the same level of revenues. The annual adjustment

The total average monthly water consumption by one family dwellings in the City during the past
winter was 386,645,000 gallons. The previous winter's monthly consumption was 443,241,000
gallons. The number of customers increased from 64,808 to 65,305. The average consumption per
customer decreased by 918 gallons per month.
Therefore, an adjustment will be made to the charges which determine individual customer's
wastewater bills beginning with service provided June 1, so that the base revenue will be maintained.
The present charge is a minimum of $9.339 for the first 2000 gallons, plus a volume charge of
51.886 for each additional thousand gallons. The new (adjusted) charge will be a minimum of
$10.146 and a volume charge of $2.049/1,000 gallons for calculating the winter average amount
which will show up on wastewater bills beginning in early July.
Each customer will be sent a letter approximately a week before the bill is sent explaining the new
wastewater winter average charge for that customer.

$1,192,300. Also, total amount of adjustments for FY97-98 are estimated to be $60,000.
Therefore, yearly "base revenues" are estimated to be $14,367,600 ($1,192,300/month x 12
months plus $60,000).
