HomeMy WebLinkAbout021995 ORD - 07/19/1994AN ORDINANCE AMENDING THE CODE OF ORDINANCES CHAPTER 53 - TRAFFIC, ARTICLE V - OPERATION OF VEHICLES, SECTION 53-120 - LEFT TURNS RESTRICTED AND SECTION 53-121 - EMERGING FROM OR ENTERING ALLEY, PRIVATE DRIVEWAY, BUILDING, ETC.; PROVIDING FOR SEVERANCE; PROVIDING FOR PUBLICATION; AND PROVIDING FOR PENALTIES ASSESSED FOR VIOLATIONS. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS. SECTION 1: That the Code of Ordinances Chapter 53 - Traffic, Article V - Operation of Vehicles, Section 53-120 - left turns restricted and Section 53-121 - emerging from or entering alley, private driveway, building, etc., as follows: Section 53-120 - Left Turns Restricted (a) No left turns into a driveway from a public street shall be made except in a residential district or except from a one-way street in any district or at such places as a "left turn only" lane or center continuous left turn lane, except as provided in Section 53-121 has been designated and marked. (b) A left turn from a one-way street to a two-way street shall be made only from the moving traffic lane nearest the left hand curb by passing to the right of the center line of the street being entered upon leaving the intersection. (c) Whenever any street has been divided to provide a continuous center left turn lane, so marked for that purpose, the following rules in addition to all others consistent herewith shall apply: (1) AG5000.525.abf 1 The driver shall not drive into the center turn lane except in preparation for a left turn or except for merging into the traffic stream from a driveway or intersection when such center lane is clear of traffic within a safe distance, and the driver has first ascertained that such a turn or merging movement can be made safely and without interference with opposing left turn traffic. Under no circumstances shall a merging movement within the 021995 2 center lane be made along a continuous distance of more than 300 feet. (2) The maximum speed limit in said center lanes shall be twenty (20) miles per hour at all times. 53-121 - Emerging From or Entering Alley, Private Driveway, Building, etc. Any vehicle emerging from a driveway, alley, building, parking lot, taxicab or bus stand, or any other place into a street within the business district, shall turn right, or left if a one-way street in the opposite direction, into the first lane of traffic. It shall be unlawful to make a Left turn, except upon one-way streets in the direction of left, upon emerging from or entering any driveway, alley, building, parking lot, taxicab or bus stand or any other place in the business district, except in cases where a "left turn only" lane or center continuous left turn lane has been designated and marked. However. based on a traffic engineering study and analysis conducted for a specific location or street section, the city manager or such officers or employees of the city designated by the city manager. is authorized to erect regulatory signage facing traffic emerging from any driveway, alley. building, narking lot, taxicab or bus stand or any other place in the business district or facing traffic on any two-way street within a business district, such signage making it unlawful to make a left turn during certain hours of the day or during all hours of any weekday and/or weekend day. irrespective of the marking of a center continuous left turn lane. raffic. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 4. Violation of these Left turn restrictions may result in traffic citations being issued and fines being assessed.
