AMENDING ORDINANCE 8127, SECTION 510, TO PROVIDE FOR, CONSISTENT WITH THE PAY ADJUSTMENTS REQUIRED BY THE POLICE COLLECTIVE BARGAINING AGREEMENT FOR NON- MANAGERIAL PERSONNEL, A 3% RANGE ADJUSTMENT TO POLICE MANAGERIAL SALARY RANGES EFFECTIVE AUGUST 8, 1994, AND 2% RANGE ADJUSTMENT EFFECTIVE JANUARY 23, 1995. AMENDING ORDINANCE 8127, SECTION 501, TO PROVIDE FOR AN APPROXIMATE 3% GENERAL INCREASE AND RANGE ADJUSTMENT FOR SALARY SCHEDULES A AND B AND GRADE 8, EFFECTIVE DECEMBER 12, 1994. AMENDING ORDINANCE 8127, SECTION 510, TO PROVIDE FOR AN APPROXIMATE 3% RANGE ADJUSTMENT TO NON -POLICE AND FIRE MANAGERIAL CLASSIFICATIONS EFFECTIVE DECEMBER 12, 1994. AMENDING ORDINANCE 3658, SECTION 103, TO EXEMPT TEMPORARY EMPLOYEES FROM THE CLASSIFIED SERVICE. AMENDING ORDINANCE 8127, SECTION 650, TO DEFINE TEMPORARY EMPLOYEE AS AT WILL. AMENDING ORDINANCE 8127, SECTION 850, TO CLARIFY LANGUAGE. AMENDING ORDINANCE 8127, SUBSECTIONS 951.13 AND 952.14, TO CLARIFY LANGUAGE ON THE CASH -IN OF SICK LEAVE. AMENDING ORDINANCE 8127, SUBSECTION 951.14, TO PROVIDE THE OPTION FOR PLAN I EMPLOYEES WHO ARE AGE 65 OR OLDER AT TIME OF HIRE OR WHO HAVE REACHED THE AGE OF 65 WHILE PARTICIPATING IN PLAN I TO DECLINE OR DISCONTINUE PARTICIPATION IN THE DISABILITY INCOME PROTECTION PLAN. AMENDING ORDINANCE 8127, SUBSECTION 955.21 TO CLARIFY LANGUAGE. AND PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION I. That Ordinance 3658, as amended, Section 250, Classification Plan for All Positions in the Classified Service, Subsections 251 through 257 be amended by amending Sections 251, 252, 253, 254, 255, 256 and 257 to read as shown in Exhibit A. SECTION 2. That Ordinance 8127, as amended, Section 510, Managerial Group Pay Plan for 1993-94, be amended by adopting the revised Managerial Group Pay Plan 1994-95 attached hereto as Exhibit B.1, providing an approximate three percent (3%) range adjustment effective August 8, 1994, to Police Managerial classifications within the Managerial Group. That Ordinance 8127, as amended, Section 510, be amended by adopting the revised Managerial Group Pay Plan 1994-95, attached hereto as Exhibit B.2, providing an approximate two percent (2%) range adjustment to Police Managerial classifications within the Managerial Group effective January 23, 1995, and approving an approximate three percent (3%) range adjustment to other Managerial salary ranges, excluding Police and Fire Managerial classifications, effective December 12, 1994, rounded to the nearest hundred, provided that individual salary advancements in the Managerial Pay Group are based on performance. 022005 r ,l_LIVitto PAGE 2 SECTION 3. That Ordinance 8127, as amended, Section 501, Salary Schedules, be amended by providing an approximate three percent (3%) general increase and range adjustment for Salary Schedules A and B and Grade 8, rounded as appropriate, effective December 12, 1994, as shown in Exhibit C. SECTION 4. That Ordinance 3658, as amended, Section 103, Adoption of the Classification Plan, be amended to read as follows: The classes of positions, as set forth in Section 250 of this Article and the specification for the respective classes, are hereby adopted and shall constitute the Classification Plan on the basis of which all positions in the Classified Service shall be Classified. Classified positions and incumbents thereof shall be subject to Civil Service in accordance with State law, the City Charter, and ordinances. Exemptions from the Classified Service include: (a) all positions included in the "Managerial group" under Section 510 of Compensation Plan Ordinance 8127, as amended August 1, 1991, or thereafter (b) each position, regardless of class title or grade, filled by an employee who functions as the principal secretary to any of the following positions: City Manager, Deputy City Manager, Dircctora Group Manager, Municipal Court Judge, Municipal Court Administrator, Department or Division Head, City Secretary, City Attorney, and Assistant City Attorney; and (c) all members of the Fire and Police Collective bargaining units; and (d) temporary employees as defined in Section 653. Except members of the Fire and Police collective bargaining units, exempt officers and employees serve at will, at the pleasure of the City Manager, or hia designee, or at the pleasure of the City Council if appointed by the City Council, and shall have and continue such at will status notwithstanding any other provision of this Classification Plan, any other City ordinance, or any rule or regulation of the City or any of its agencies. SECTION 5. That Ordinance 8127, as amended, Section 650, Subsection 653, Cempcnoati. not Temporary Employees, be amended to read as follows: 653 A temporary employee shall be defined as any employee who is employed for a known period of time to perform a specific function of temp rary nature fixed term, or to perform a specific task, has no Civil Service status under Civil Service Board Rules and Regulations and may be terminated at will at any time during the temporary period of employment. All such employment must be specified as to the length of time anticipated to complete the temporary assignment on the appropriate form on initial employment. A temporary employee shall be paid on an hourly rate basis as approved by the City Manager. r PAGE 3 SECTION 6. That Ordinance 8127, as amended, Section 850, Personally -Owned Vehicle Automobilc and Motorcycic Allowance, be amended to read as follows: 850.1 An officer or employee of the City who is required to have available and to regularly operate his or her personally owned vehicle automobile in the conduct of City business shall be paid as determined by standard instructions administrative procedures issued by the City Manager for auto allowance mileage reimbursement. SECTION 7. That Ordinance 8127, as amended, Section 950, Leaves of Absence, 951.0, Plan I Employees, Subsection 951.13, Cash -in of Sick Leave, be amended to read as follows: 951.13 Cash -in of Sick Leave. A Plan I Employee who has at least 240 hours of accumulated sick leave and who has not taken more than 32 hours of sick leave in the previous calendar year, may cash -in up to 32 hours of accumulated sick leave in a calendar year at 500 of salary or hourly rate of pay., provided that the employee SECTION 8. That Ordinance 8127, as amended, Section 950, Leaves of Absence, 951.0, Plan I Employees, Subsection 951.14, Disability Income Protection Plan, be amended to read as follows: 951.14 Disability Income Protection Plan. Plan I Employees will automatically be members of the City's Disability Income Protection Plan and eligible to apply for extended benefits under that plan provided that employees age 65 at the date of hire and employees who have reached the age of 65 while oarticjpating in Plan I, shall have the option to decline or discontinue participation. The Risk Manager shall be the administrator of the plan on behalf of the City and member employees. The employee's cost of basic membership in the plan will be paid for equally by the City and the member employee. Any supplemental income protection available beyond the basic plan coverage will be solely at the expense of the employee. SECTION 9. That Ordinance 8127, as amended, Section 952.0, Plan II Employees, Subsection 952.14, be amended to read as follows: 952.14 Cash -in of Sick Leave. A Plan II Employees who have has accrucd at least 720 hours or more accummulated sick leave and who has not taken more than 32 hours of sick leave in the previous calendar year, -salary rate, 50% of all unused Dick lcavc hours accrucd during the prior y ar over G4 hours may cash -in up to 32 hours of accummulated sick leave in a calendar year at 50% of salary or hourly rate of pay. That Ordinance 8127, as amended, Section 955, Special Leave, Subsection 955.21, be amended to read as follows: The City Manager may authorize lump -sum payments for involuntary termination, including requested resignations, within the managerial group in amounts not to exceed the equivalent of six (6) months' salary. SECTION II. If, for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose.
