A RESOLUTION NOMINATING AND DESIGNATING CITGO
REFINING AND CHEMICALS, INC. AS A QUALIFIED BUSINESS AND
ENTERPRISE PROJECT PURSUANT TO THE TEXAS ENTERPRISE
ZONE ACT, V.T.C.A, GOVERNMENT CODE, CHAPTER 2303.
WHEREAS, the City of Corpus Christi ("City") desires to pursue the creation of an
economic and social environment which will induce the investment of private resources in
productive business enterprises located in The Corpus Christi Enterprise Zone ("Zone") and will
provide employment to residents of the Zone and to other economically disadvantaged
individuals;
WHEREAS, the City of Corpus Christi City Council ("City Council") has nominated the
Corpus Christi Enterprise Zone Expansion subject to Texas Department of Commerce designation
of same;
WHEREAS, the Texas Enterprise Zone Act, V.T.C.A., Government Code, Chapter 2303
(the "Act") authorizes the designation of enterprise projects within an enterprise zone;
WHEREAS, the City finds that Citgo Refining and Chemicals, Inc., or its successor in
interest ("Citgo") meets the criteria for designation as an enterprise project under an Act of June
19, 1993, 73rd Leg., Chapter 986, §31 on the following grounds:
1. Citgo is a "qualified business under Section 2303.401 of the Act since it is engaged in
the active conduct of a trade or business in the Zone and at least twenty-five (25%)
percent of the additional employees will be residents of the Zone or economically
disadvantaged individuals;
2. Citgo is located in the Zone which has an unemployment rate of not less than one and
one-half (1-1/2) times the State unemployment rate;
3. There had been and will continue to be a high level of cooperation between public,
private, and neighborhood entities within the Zone; and
4. The designation of Citgo as an enterprise project will contribute significantly to the
achievement of the plans of the City for development and revitalization of the zone; and
WHEREAS, the City finds that it is in the best interest of the City to nominate Citgo as
an enterprise project pursuant to the Act;
NOW, THEREFORE, BE IT RESOLVED BY THE HE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI, TEXAS, THAT:
SECTION 1. The findings of the City and its actions approving this Resolution taken at
the Council Meeting are hereby approved and adopted.

SECTION 2. Citgo is a "qualified business", as defined in Section 2303.401 of the Act,
and meets the criteria for designation as an enterprise project, as set forth in Section 2303.105 of
the Act.
SECTION 3. The City hereby nominates Citgo as an enterprise project in accordance
with Section 2303.105 of the Act, and authorizes the City Manager or his designee to file an
application requesting designation of Citgo as an enterprise project with the Texas Department of
Commerce, and to execute all documents and agreements necessary to process said application.
This nomination is subject to designation of the zone expansion by the Texas Department of
Commerce pursuant to Section 2303.107 of the Act.
SECTION 4. Upon approval of the Texas Department of Commerce, the enterprise
project will be named Citgo - Corpus Christi Refinery.
SECTION 5. The enterprise project shall take effect on the date of designation of the
enterprise project by the Texas Department of Commerce and terminate five (5) years after date
of designation.
