HomeMy WebLinkAbout022011 RES - 08/09/1994A RESOLUTION CONCERNING LEGISLATION PREEMPTING THE RIGHT OF THE CITY OF CORPUS CHRISTI TO BE COMPENSATED FOR THE USE OF CITY STREET RIGHTS-OF-WAY BY TELEPHONE AND CABLE TELEVISION COMPANIES WHEREAS, telephone and cable television companies use the public street rights-of-way in the City of Corpus Christi for cables and other transmission and communication equipment necessary to their operations; and WHEREAS, the City of Corpus Christi cooperates with such telephone and cable television companies in obtaining and providing the right to use such rights-of-way for such purposes; and WHEREAS, telephone and cable television companies have agreed to compensate the City of Corpus Christi for such use of public rights-of-way by paying street rental fees as specified in franchise agreements; and WHEREAS, the United States Congress is considering legislation which may prohibit the City of Corpus Christi from receiving such compensation from telephone and cable television companies; and WHEREAS, the City of Corpus Christi through its membership in the National League of Cities and its affiliate, the National Association of Telecommunications Officers and Advisors, has supported the United States Congress in taking reasonable and necessary steps to regulate the telephone and cable television industries; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: Section 1. That any legislation preempting the right of the City of Corpus Christi to be compensated for the use of City street rights-of-way by telephone and cable television companies would unfairly penalize the citizens of Corpus Christi who bear the cost of such rights-of-way. Section 2. That the United States Congress is urged to support the recommendations of the National Association of Telecommunications Officers and Advisors to amend S. 1822; and to oppose any amendments to S. 1822 that strip local governments of their existing authority to collect cable franchise fees or revenues generated from non -cable telecommunications services over a cable system, or limit the rights of local governments to collect franchise fees and similar assessments from local competitive access providers for use of local public property. That the City Secretary is directed to send copies of this resolution to the local Congressional delegation and members of the United States Senate Commerce, Science, and Transportation Committee.
