ORDINANCE
WITHDRAWING THE DESIGNATION OF THE CORPUS CHRISTI ENTERPRISE
ZONE; AND DESIGNATING A NEW CORPUS CHRISTI ENTERPRISE ZONE WITH
EXPANDED BOUNDARIES, AND AUTHORIZING THE FILING OF AN
APPLICATION WITH THE TEXAS DEPARTMENT OF COMMERCE
WHEREAS, the City Council of the City of Corpus Christi, Texas, ("City") has
recognized the importance of economic development to the City;
WHEREAS, the City has determined that there are benefits for the City and Nueces
County which may be derived from having an Enterprise Zone Program in accordance with the
Texas Enterprise Zone Act, V.T.C.A., Government Code, Chapter 2303 ("Act");
WHEREAS, the City has directed the City Manager to develop a City of Corpus Christi
Enterprise Zone Program and to recommend the definite geographical boundaries and specific
economic development incentives of such Enterprise Zone Program;
WHEREAS, the Act contemplates nomination by the City to the Texas Department of
Commerce, of any economically distressed area within the City which meets the criteria of the
Act as a potential enterprise zone;
WHEREAS, in accordance with the Act, the Texas Department of Commerce heretofore
approved, on November 22, 1989, the nomination of the City of Corpus Christi Enterprise Zone
("Zone") as an enterprise zone pursuant to the City's Resolution No. 20806; and
WHEREAS, in accordance with the Act, the Texas Department of Commerce heretofore
approved, on December 23, 1991, the nomination for the expansion of the Zone as an enterprise
zone pursuant to the City's Ordinance No. 21265;
WHEREAS, the existing Zone expires in 1996;
WHEREAS, the City now desires to withdraw the designation of the existing Corpus
Christi Enterprise Zone and designate a new Corpus Christi Enterprise Zone for a period of
seven years with expanded boundaries (hereinafter referred to as the "New Zone") in accordance
with Section 2303.101. of the Act, which section establishes an application process for the
designation of an enterprise zone; and
WHEREAS, in compliance with Section 2303.101. of the Act on August 9, 1994, the
City held a public hearing to consider expanding the boundaries of the Zone;

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF CORPUS CHRISTI:
SECTION 1. The boundaries of the New Zone will include the current boundaries of
the Zone; the 1991 expansion area; and some additional expansion area. Exhibit A, attached
hereto and incorporated by reference, is a general description of the boundaries of the New
Zone.
SECTION 2. The City has determined that it is desirable to withdraw the designation
of the existing zone before it will expire in 1996, and designate a new zone for a period of seven
(7) years with expanded boundaries.
SECTION 3. The City has determined and finds that the New Zone meets the
requirements of Section 2303.101 of the Act, namely:
(1) to have a continuous boundary;
(2) be at least one square mile but not larger than the greater of:

(A) 10 square miles, excluding lakes, waterways, and transportation
arteries; or
(B) an area, not to exceed 20 square miles, that is equal to five percent
of the area, excluding lakes, waterways, and transportation
arteries, of the municipality, county, or combination of
municipalities or counties nominating the area as an enterprise
zone;
be an area of pervasive poverty, unemployment, and economic distress;
and
SECTION 4. Pursuant to the Act, the New Zone is hereby nominated as an enterprise
zone, subject to the approval of the Texas Department of Commerce in accordance with the Act.
SECTION 5. The City will provide certain tax and other incentives applicable to
business in the enterprise zone, the first four of which are not available throughout the City, as
follows:
a. Public Works Improvements;
b. Enterprise Zone Signage Program;
c. Enterprise Zone Expeditor;

d. Enhanced Police Services;
e. City of Corpus Christi Tax Abatement as provided by the Guidelines and Criteria
for Granting Tax Abatement;
f. Tax Exempt Revenue Bonds;
g.
The Corpus Christ Foreign Trade Zone;
h. Tax Increment Financing in the Reinvestment Zone #1, as established in
Ordinance No. 19708;
i. Federal Economic Development Administration (EDA) Public Works Grants;
J.
Corpus Christi Commercial Rehabilitation Loan Program;
k. Housing and Urban Development 312 Rehabilitation Loan Program as federal
funds become available; and
1. Minority Business Opportunity Council.
SECTION 6. The City of Corpus Christi Office of the City Manager is hereby
designated as the City's administrative agency to administer the Act within the New Zone located
wholly within the area of the corporate limits and the extraterritorial jurisdiction of the City.
SECTION 7. The City Manager is hereby authorized and directed to submit an
application to the Texas Department of Commerce for the designation of the New Zone as a
designated enterprise zone pursuant to the Act.
SECTION 8. The City hereby authorizes the City Manager or his designee to sign and
enter into a negotiated enterprise zone agreement with the Texas Department of Commerce, and
to take all action necessary to accomplish the purposes of this Ordinance.
SECTION 9. The City Manager or his designee is further directed to act as liaison for
the City to communicate and negotiate with the Texas Department of Commerce, enterprise
projects, and other entities in order affected by the enterprise zone.
SECTION 10. All City Ordinances and Resolutions, and provisions of City Ordinances
and Resolutions, in conflict herewith are hereby expressly repealed; provided, that if the
application as described in Section 6 of this Ordinance is not approved by the Texas Department
of Commerce, and thus the New Zone is not designated as an enterprise zone by the Texas
Department of Commerce pursuant to the Act, nothing herein, nor the refusal of the Texas
Department of Commerce to designate the New Zone as an enterprise zone, shall in any way

whatsoever be construed to affect or nullify the original nomination and designation of the Zone
as an enterprise zone as approved by the Texas Department of Commerce.
SECTION 11. The provisions of this Ordinance are severable. If any section,
subsection, paragraph, sentence, clause or phrase of this Ordinance is declared invalid by any
court of competent jurisdiction, such declaration of invalidity shall not affect the remainder of
this Ordinance which shall continue in effect.
SECTION 12. That upon written request of the mayor of five Council members, copy
attached, to find and declare an emergency due to the need for immediate action necessary for
the efficient and effective administration of City affairs, such finding of an emergency is made
and declared requiring suspension of the Charter rule as to consideration and voting upon
ordinances at two regular meetings so that his ordinance is passed and shall take effect upon first
reading as an emergency measure this the 11th day of October, 1994.

For the reasons set forth in the emergency clause of the foregoing
ordinance an emergency exists requiring suspension of the Charter
rule as to consideration and voting upon ordinances at two regular

rule and pass this ordinance finally on the date it is introduced,
or at the present meeting of the City Council.
