HomeMy WebLinkAbout022053 ORD - 10/11/1994AN ORDINANCE CHANGING THE INSURANCE REQUIREMENTS AND PERMIT FEES IN CHAPTER 33, ARTICLE V. OUTDOOR MUSIC FESTIVALS; PROVIDING FOR SEVERANCE; AND DECLARING AN EMERGENCY. WHEREAS, Anahuac Entertainment Corporation has approached the City of Corpus Christi Park and Recreation Department about holding a Brujita Night/Halloween Bash, Tejano Music Festival on October 30, 1994; and, WHEREAS, Chapter 33, Article V., Outdoor Music Festivals was adopted in 1973 and the insurance provisions and permit fees are outdated; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: SECTION 1: That the insurance requirements in Section 33-91 are hereby changed to comprehensive general liability of $500,000 for personal injury or death, $1,000,000 per occurrence and $100,000 for property damage, and liquor liability coverage for $1,000,000. SECTION 2: That the permit fees are hereby changed to a $25.00 permit fee and 5% of gross receipts or direct City costs whichever are greater. SECTION 3: If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4: That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect uponrpt reading as an emergency measure this the 1 day of WO r 19 t .
