HomeMy WebLinkAbout022056 ORD - 10/11/1994AN ORDINANCE CLOSING AND ABANDONING 301 -SQUARE FOOT PORTION OF A 3 - FOOT WIDE ELECTRICAL EASEMENT ON LOT 51, BLOCK 2, CREEKWAY SUBDIVISION, SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 301 -square foot portion of a 3 -foot wide electrical easement on Lot 51, Block 2, Creekway Subdivision, by plat recorded in Volume 47, Pages 100-101, of the Map Records of Nueces County , Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY 1'HE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 301 -square foot portion ofa 3 -foot wide electrical easement on Lot 51, Block 2, Creekway Subdivision, as shown by plat recorded in Volume 47, Pages 100-101, of the Map Records, Nueces County, Texas, as shown on Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) Owner will reimburse Central Power & Light $1,150.00 to re-route the cable around the lot. 2) property being replatted at applicant's expense within 180 days of passage of this ordinance, provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the applicant's control necessitate an extension; and AG5000.634 September29, 1994 `'2 56 MiQF1LMEQ; 3) Owner will dedicate a new electrical easement equal in area, when replatted by the owner, as set out in 2) above, in lieu of payment of the fair market value required by the City. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the H day of (`(‘Ivhj Y , 1994.
