HomeMy WebLinkAbout022057 ORD - 10/11/1994AN ORDINANCE CLOSING AND ABANDONING 8,880.14 SQUARE FOOT PORTION OF A 10 -FOOT WIDE UTILITY EASEMENT ON TRACTS 1 & 3, OAKHURST PLAZA, SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 8,880.14 square foot portion of a 10 -foot wide utility easement on Tracts 1 & 3, Oakhurst Plaza, by plat recorded in Volume 52, Pages 93 & 95, of the Map Records of Nueces County , Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 8,880.14 square foot portion of a 10 -foot wide utility easement on Tracts 1 & 3, Oakhurst Plaza as shown by plat recorded in Volume 52, Pages 93 & 95, of the Map Records, Nueces County, Texas, as shown on Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) that the Owner dedicate a new utility easement or conduit to the property line/right-of-way, for SWB to serve any structure or facility built on this location in the future. 2) that Owner dedicate the new utility easement equal in area in lieu of paying the fair market value. 3) that Owner replat the property at his expense within 180 days of passage of this ordinance, provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension; and AG5000.636 October 4, 1994 92u57 r t+1ICRO_FILMED SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the // day of fifrriedz( , 1994.
