HomeMy WebLinkAbout022089 ORD - 11/22/1994AN ORDINANCE CLOSING AND ABANDONING A 1414.20 SQUARE FOOT PORTION OF A 15 -FOOT WIDE BY 94.28 -FOOT LONG UTILITY EASEMENT IN BETWEEN LOTS 10, 11, 12, & 13, BLOCK 7, OCEAN VIEW ADDITION, SUBJECT TO THE COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND 1HE OWNER REPLATTING THE PROPERTY WITHIN 180 DAYS AT HIS EXPENSE; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 1414.20 square foot portion of a 15 -foot wide by 94.28 - foot long utility easement in between Lots 10, 11, 12, & 13, Block 7, Ocean View Addition, by plat recorded in Book 1, Page 11, of the Map Records of Nueces County , Texas (said 15 -foot wide utility easement was previously a 15 -foot wide Alley closed by City Ordinance No. 7672); WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 1414.20 square foot portion of a 15 -foot wide by 94.28 -foot long utility easement in between Lots 10, 11, 12, & 13, Block 7, Ocean View Addition, as shown by plat recorded in Book 1, Page 11, of the Map Records, Nueces County, Texas, as shown on Exhibit "A", be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: AG5000.640 1) That the Owner dedicate and provide a 5 -foot utility easement on the west and north side of said property. 2) That the Owner pay Southwestern Bell the approximate cost of $3,465.00 for relocating all cables, poles, and other hardware on the property belonging to Southwestern Bell Telephone Company. 3) That Owner pay the fair market value of $1,250.00 for the portion of the utility easement being closed. 4) That Owner replat the property at Owner's expense within 180 days of passage of this ordinance; provided however, the City Engineer may extend the time for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. ,02139 ¶ Er, SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 22 day of Nov%t tIoe V' , 1994.
