HomeMy WebLinkAbout022099 ORD - 12/13/1994AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY MICHELE HERMIS, BY CHANGING THE ZONING MAP IN REFERENCE TO SOUTHSIDE ADDITION UNIT 4, BLOCK 38, LOT 19 FROM "R-2" MULTIPLE DWELLING DISTRICT TO "B-1" NEIGHBORHOOD BUSINESS DISTRICT AND GRANTING A SPECIAL PERMIT FOR A SMALL ENGINE AND LAWNMOWER REPAIR SHOP AND AN AUTO SALES LOT ON BLOCK 40, SUBJECT TO FIVE (5) CONDITIONS; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Michele Hermis, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, November 2, 1994, during a meeting of the Planning Commission and on Tuesday, December 13, 1994, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That the zoning map in reference to Southside Addition Unit 4, Block 38, Lot 19, located on the west side of Kostoryz Road, approximately 100 feet south of Mansheim Boulevard, be changed from "R-2" Multiple Dwelling District to "B-1" Neighborhood Business District. SECTION 3. That a Special Council Permit be granted for a small engine and lawnmower repair shop and an auto sales lot on Southside Addition Unit 4, Block 40, located on the southwest corner of Mansheim Boulevard and Kostoryz Road, subject to five (5) conditions: USES: The only uses authorized by this Special Permit other than the basic "B-1" Neighborhood Business District uses are a small engine and lawnmower repair shop and an auto sales lot. The existing 1,200 square foot metal building may be used for the conditional uses but may not be expanded. 94NH2830.350 / 1094-3 T T a2J9 1 j i a°. 2 2. REPAIR SHOP: The small engine and lawnmower repair shop must be located in the existing metal building in the rear of Block 40. All repair work and storage must be done inside the building. 3. AUTO SALES: The auto sales lot must be located at the rear 58 feet of Block 40 and may not contain more than five (5) vehicles for sale at any one time. The auto sales office must be located within the metal building at the rear of the property. Outside paging, speakers, or telephone bells are prohibited. 4. LIGHTING: All security lighting must be directional lighting and directed away from the residential area. SCREENING: A standard six (6) foot screening fence must be installed along the south and west property lines of Lot 19 and along the west property line of Block 40. The screening fence must be installed within one (1) year of the date of this ordinance. SECTION 4. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 5. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 6. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. SECTION 7. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 8. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 9.
