HomeMy WebLinkAbout022113 ORD - 12/20/1994AN ORDINANCE AMENDING THE CAPITAL BUDGET FOR FISCAL YEAR 1994-95, AS ADOPTED IN ORDINANCE NO. 022076, TO AUTHORIZE $2,910,000 TO CONSTRUCT THE COLUMBUS FLEET SHIPYARD AND SEAPORT; $900,000 FOR IMPROVEMENTS TO THE CITY'S MUSEUM OF SCIENCE AND HISTORY IN CONNECTION WITH DISPLAYING THE SMITHSONIAN INSTITUTION'S SEEDS OF CHANGE EXHIBIT, AND $1,490,000 FOR A THERMAL ENERGY STORAGE SYSTEM AT THE BAYFRONT ARTS AND SCIENCES PARK; FUNDING SOURCES TO BE CERTIFICATES OF OBLIGATION ISSUED FOR SUCH PURPOSES; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. NOW, 1IILREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. The Capital Budget for Fiscal Year 1994-95, as adopted in Ordinance No. 022076, is hereby amended to authorize the following additional projects, with funding sources as noted: (1) $2,910,000 for construction of the Columbus Fleet Shipyard and Seaport - funded from City of Corpus Christi, Texas, Combination Tax and Municipal Hotel Occupancy Tax Revenue, Certificates of Obligations, Series 1994-A as appropriated; (2) $900,000 for improvements to the City's Museum of Science and History in connection with displaying the Smithsonian Institution's Seeds of Change exhibit - funded from City of Corpus Christi, Texas, Combination Tax and Municipal Hotel Occupancy Tax Revenue Certificates of Obligation, Series 1994-B as appropriated; and (3) $1,490,000 for a thermal energy storage system at the Bayfront Arts and Sciences Park - funded as in (2); and to increase the total capital budget and funding sources to $52,084,099. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. Upon written request of the Mayor or five Council Members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient utilization of physical resources in the City, for the efficient and effective administration of City affairs, and to complete these vital projects at the earliest possible time, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so tha{ t1his ordinance is passed and shall take effect upon first reading as an emergency measure this the day of :r ' -2( , 1994.
