HomeMy WebLinkAbout022116 ORD - 12/20/1994AN ORDINANCE AUTHORIZING THE CITY MANAGER TO EXECUTE ON BEHALF OF THE CITY OF CORPUS CHRISTI AN AMENDMENT TO THE LEASE AGREEMENT WITH THE PORT OF CORPUS CHRISTI AUTHORITY OF NUECES COUNTY, TEXAS, AUTHORIZED BY ORDINANCE NO. 10435 ON AUGUST 25, 1971, IN ORDER TO SUBLET THE PREMISES TO THE LAS CARABELAS COLUMBUS FLEET ASSOCIATION FOR MUSEUM DISPLAY OF THE COLUMBUS SHIP REPLICAS; PROVIDING FOR SEVERABILITY; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF CORPUS CHRISTI, TEXAS, THAT: SECTION 1. The City Manager is hereby authorized to execute an amendment to the Lease Agreement with Nueces County Navigation District No. 1 (now the Port of Corpus Christi Authority of Nueces County, Texas) authorized by Ordinance No. 10435 on August 25, 1971, a substantial copy of which amendment is attached hereto as Exhibit A, and made part hereof. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient utilization of physical resources in the City and for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the .Lc day of j Y ,1 Y , 1994. Martin Dr. David McNichols David Noyola Clif Moss URB\ORD\010.jrb(aar) Jc '22116 AMENDMENT TO LEASE AGREEMENT FROM PORT OF CORPUS CHRISTI AUTHORITY OF NUECES COUNTY, TEXAS TO CITY OF CORPUS CHRISTI, TEXAS WHEREAS, on August 25, 1971, Nueces County Navigation District No. 1 entered into a lease agreement (hereinafter "the Lease") with the City of Corpus Christi, Texas (hereinafter "City"), authorized by the City Council of City in Ordinance No. 10435, to lease to City .48 acres of land, more or less, adjacent to the ship channel at the Port of Corpus Christi for park purposes for a thirty year term through July 31, 2001; and WHEREAS, the name of Nueces County Navigation District No. 1 was subsequently changed by the Texas Legislature to the Port of Corpus Christi Authority of Nueces County, Texas (hereinafter "Port Authority"); and WHEREAS, City and Port desire to amend the Lease in order accomplish their mutual public purposes by facilitating the museum display of the Columbus Ship Replicas by the Las Carabelas Columbus Fleet Association. NOW, THEREFORE, City and Port agree to amend the Lease as follows: 1. Insert between the first and second sentence of Part II, the following: "It is acknowledged that said purpose includes museum facilities and operation." 2. Insert at the end of Part IV the following: "Provided, however, Port hereby consents to City subleasing the premises to the Las Carabelas Columbus Fleet Association for all purposes related to museum display of the Columbus Ship Replicas." 3. In the last line of Part I, delete "2001" and substitute therefore "2015". This agreement shall be effective upon signing by both parties and shall be executed in duplicate originals.
