HomeMy WebLinkAbout022124 ORD - 12/20/1994AN ORDINANCE CLOSING AND ABANDONING A 20 -FOOT WIDE BY 300 -FOOT LONG PORTION OF AN ALLEY RIGHT-OF-WAY, FROM REHFELD ROAD TO CRYSTAL LANE, BETWEEN LOTS 1 THROUGH 5, BLOCK 1, AND LOTS 1 AND 20, BLOCK 2, RIVERSIDE PARK ADDITION, BUT RETAINING BOTH A 10 -FOOT WIDE BY 300 -FOOT LONG UTILITYEASEMENT ALONG THE NORTH HALF OF THE ALLEY RIGHT-OF-WAY AND A 10 - FOOT WIDE BY A 10 -FOOT LONG UTILITY EASEMENT IN THE MIDDLE OF THE ALLEY CLOSURE ADJACENT TO AND INTERSECTING WITH THE UTILITY EASEMENTS FOR LOTS 1 AND 20, BLOCK 2, RIVERSIDE PARK ADDITION; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 20 -foot wide by 300 -foot long portion of an alley right-of-way, from Rehfield Road to Crystal Lane, between Lots 1 through 5, Block 1, and Lots 1 and 20, Block 2, Riverside Park Addition as shown by plat recorded in Volume 14, Page 4 of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 20 -foot wide by 300 -foot long portion of an alley right-of-way, from Rehfeld Road to Crystal Lane, between Lots 1 through 5, and Lots 1 and 20, Block 20, Riverside Park Addition, as shown by plat recorded in Volume 14, Page 4, of the Map Records, Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: AG5000.648.vr 1) that the City retain a 10 -foot wide by 300 -foot long utility easement within the north half of the alley right-of-way as shown on the attached and incorporated Exhibit "A'; 2) that the City retain a 10 -foot wide by 10 -foot long utility easement in the middle of the alley closure adjacent to and intersecting with the utility easements for Lots 1 and 20, Block 2, Riverside Park Addition as shown on Exhibit "A"; '`�91 04 mtegFoJtiis 3) that Owner provide City Staff with a letter stating that the owners of Lots 1-5, Block 1, Riverside Park Addition, do not oppose the alley closure nor do they want to purchase any of the property being closed, which letter includes the name, address, lot owned, and signature of each owner; 4) that Owner pay the fair market value of $2,050.00.; 5) that Owner replat the property at his expense within 180 days of passage of this ordinance; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 2` day of \ ye)( , 1994.
