HomeMy WebLinkAbout022174 ORD - 02/28/1995AN ORDINANCE AMENDING THE CORPUS CHRISTI ZONING ORDINANCE, BY AMENDING ARTICLE 3, DEFINITIONS BY DEFINING "OUTSIDE STORAGE"; AMENDING ARTICLE 12, "B-1" NEIGHBORHOOD BUSINESS DISTRICT, ARTICLE 13, "B -2A" BARRIER ISLAND BUSINESS DISTRICT, AND ARTICLE 14, "B-2" BAYFRONT BUSINESS DISTRICT BY PROHIBITING OUTSIDE STORAGE; AMENDING ARTICLE 15, "3-3" BUSINESS DISTRICT, ARTICLE 16, "11-4" GENERAL BUSINESS DISTRICT, AND ARTICLE 20, "I-2" LIGHT INDUSTRIAL DISTRICT BY PERMITTING OUTSIDE STORAGE; AND DECLARING . 'AN EMERGENCY. AMENDING ARTICLE 29, THE BOARD OF ADJUSTMENT BY ALLOWING A SPECIAL USE EXCEPTION FOR HEIGHT IN "B-3", "B-4", "B-5", "11-6", AND "I-2" ZONING DISTRICTS. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: SECTION 1. That the Zoning Ordinance, Article 3, Definitions, Article 12, 'B-1" Neighborhood Business District, Article 13, "B -2A" Barrier Island Business District, Article 14, "B-2" Bayfront Business District, Article 15, "B-3" Business District, Article 16, "B-4" General Business District, Article 20, "I-2" Light Industrial District, and Article 29, The Board of Adjustment, is hereby amended as follows: ARTICLE 3. DEFINITIONS Section 3-1.50.2 Outside Retail Display. An unenclosed area used as an accessory use to a primarily retail sales use to display items for sale. When allowed, such area: 11 Shall be limited to ten feet of the retail sales store -front which fronts the front yard; 2) Shall not extend greater than 50% of such retail sales store -front 1) Shall not encroach upon minimum yard. minimum parking area, or fire lane. Section 3-1.50.3 Outside Retail Sales Area. An unenclosed area used as an accessory use to aprimarily retail sales use to accommodate customers and contain items for sale beyond the allowable outside retail display area. This definition does not include outside areas related to the sale or rental ofportable buildings, automobiles, boats, boat trailers, motorcycles, mobile homes, or recreational vehicles. Where allowed, outside retail sales areas: 95NH2830.205.njh 02.10-95 02.2174 IURUIJL6VIEVI, 2 1� Are limited in area to 15% of gross floor area of primary uses of 3.000 square feet or less. to 450 square feet for primary uses over 3,000 square feet and less than 4,500 square feet. and 10% of gross floor area for primary uses over 4,500 square feet 4) Are required to be screened from view from adjacent properties. including public rights-of-way, with a solid screen of not less than six (6) feet in height and at least as high as the materials being screened except for growing plants. Shall not encroach upon minimum yards, minimum parking area, or fire lanes. Shall be considered as retail sales floor area for purposes of calculating parking loading, open space and floor area factors but not for determining street yard. Section 3-1.50.4 Outside Storage. An area used for the unenclosedplacement of any items for a continuous period in excess of 24 hours, including equipment used primarily off-site, other than outside retail display. outside retail sales, or outside areas related to the sale or rental of portable buildings, automobiles, boats, boat trailers, motorcycles. mobile homes or recreational vehicles. ARTICLE 12. Section 12-2 "B-1" NEIGHBORHOOD BUSINESS DISTRICT REGULATIONS Use Regulations. (12) Accessory buildings and uses customarily incidental to the use permitted in the district, except that outside storage and outside sales area are not permitted. ARTICLE 13. Section 13-2 "B -2A" BARRIER ISLAND BUSINESS DISTRICT REGULATIONS Use Regulations. (23) Accessory buildings and uses, except that outside storage and outside sales area are not permitted. "B-2" BAYFRONT BUSINESS DISTRICT REGULATIONS Use Regulations. ARTICLE 14. "3-3" BUSINESS DISTRICT REGULATIONS (16) Accessory buildings and uses, except that outside storage is not permitted. ARTICLE 16. "B-4" GENERAL BUSINESS DISTRICT REGULATIONS Section 16-2 Use Regulations. (16) Accessory buildings and uses, except that outside storage is not permitted. ARTICLE 20. "I-2" LIGHT INDUSTRIAL DISTRICT REGULATIONS Section 20-2 (4) Use Regulations. Unclassified Uses Outside Storage (i) All outside storage shall be screened from view from the at -grade public right-of-way- (ii) ight-of-way (ii) The outside storage may not be located in the required minimum building setbacks. ARTICLE 29. THE BOARD OF ADJUSTMENT Section 29-3 Special Use Exceptions. 29-3.11 To allow materials stored as outside retail sales or outside storage in a "B-3" District. "B-4" General Business District, "B-5" Primary Business District, "B-6" Primary Business Core District or "I-2" Light Industrial District to exceed the height of the screen. SECTION 2. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 3. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby amended to conform to the Zoning Ordinance as amended herein. 95NH2830.205.njh 02-10-95 4 SECTION 4.
