HomeMy WebLinkAbout022178 ORD - 03/14/1995ORDINANCE APPROPRIATING $ 199,766.00 RECEIVED FROM TEXAS A & M UNIVERSITY -CORPUS CHRISTI ("TAMU-CC") AS THE UNIVERSITY'S SHARE FOR WATER IMPROVEMENTS ON THE TAMU-CC CAMPUS; AMENDING ORDINANCE NO. 022076, WHICH ADOPTED THE FY 1994-95 CAPITAL BUDGET, TO ADD $199,766.00 TO THE NO. 205 WATER CAPITAL IMPROVEMENT FUND; AND DECLARING AN EMERGENCY. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That there is hereby appropriated $ 199,766.00 received from Texas A & M University Corpus Christi ("TAMU-CC") as the university's share for water improvements on the TAMU-CC campus. SECTION 2. That Ordinance No. 022076, which adopted the FY 1994-95 Capital Budget, is amended to add $199,766.00 to the No. 205 Water Capital Improvement Fund. SECTION 3. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of city affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that thi ordinance is pass � dn anshall take effect upon first reading as an emergency measure this the [1 day of 'V Vrt , 1995. AN AGREEMENT WHEREAS, Texas A&M University - Corpus Christi (University) is in the process of implementing a major capital improvements program in order to expand to a full four- year institution; and WHEREAS, the contemplated capital improvements will require water for domestic use and fire protection beyond the delivery capabilities of the present water distribution system and wastewater collection beyond the capabilities of the present lift station and force main which serves the campus; and WHEREAS, the City of Corpus Christi (City) is committed to support the University in its endeavors to provide quality educational facilities for South Texas, NOW, THEREFORE, the City and University agree as follows: 1. The Water System Study 1991-2010, prepared by Urban Engineering, for the Facilities Planning and Construction Department of the Texas A&M University System identified water system improvements needed to meet the domestic and fire flow demands of the Corpus Christi campus. A portion of those water facilities: are to be funded by the City and a portion by the University. Exhibit "A" attached hereto depicts the proposed improvements and respective responsibilities of the parties. 2. The project costs and funding responsibilities of the parties are enumerated on the attached Exhibit "B". 3. The City has, through the services of a consulting engineer, developed plans and specifications and received bids for the construction of the water system improvements as outlined on Exhibit "A" attached hereto as well as any improvements to the sanitary sewer lift station and force main to accommodate anticipated future growth. The plans and specifications were jointly approved by City and University. 4. The City will provide contract administration and inspection services associated with the construction of these facilities. These services will be comparable to those provided on other City capital improvements projects. 5. Prior to the award of the construction contract, the University shall execute and return this Agreement. The University shall remit to the City, within 30 days of execution of this Agreement, the University's share of the project cost, which is $199,766.00. 6. Portions of the improvements will be maintained by the City.
