HomeMy WebLinkAbout022242 ORD - 05/23/1995AN ORDINANCE CLOSING AND ABANDONING A 23,850 -SQUARE FOOT PORTION OF DEMPSEY STREET RIGHT-OF-WAY FROM NUECES BAY BOULEVARD TO FLORAL STREET AND A 10 -FOOT WIDE BY 476 -FOOT LONG ALLEY BETWEEN LOTS 1-10 AND LOTS 11-20, BLOCK 3, SUNSET PLACE (FROM NUECES BAY BOULEVARD TO FLORAL STREET); SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 23,850 -square foot portion of Dempsey Street right-of-way from Nueces Bay Boulevard to Floral Street and a 10 -foot wide by 476 -foot long alley between Lots 1-10 and Lots 11-20, Block 3, Sunset Place, shown by plat recorded in Volume A, Page 25, and Volume 4, Page 25, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way and alley, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 23,850 -square foot portion of Dempsey Street right-of-way from Nueces Bay Boulevard to Floral Street and a 10 -foot wide by 476 -foot long alley between Lots 1-10 and Lots 11-20, Block 3, Sunset Place, as shown by plat recorded in Volume A, Page 25, and Volume 4, Page 25, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner dedicate a 10 -foot wide utility easement running east -west along the northern lane of Dempsey Boulevard to provide service to the area. 2) That Owner cut, plug, and abandon an 8 -inch sanitary sewer line. 3) That Owner dedicate a 10 -foot wide utility easement running east -west along the southern portion of Dempsey Street. 4) That Owner reimburse Southwestern Bell the cost of removing their cable, poles, anchors, and guys in addition to other work including splicing, reguying of cables and engineering cost associated with removing their facilities from this portion of Dempsey Street. 95ag5000.690.vr May 11, 1995 0294% dicatilaLMLU 5) That Owner reimburse Central Power & Light Company for all relocation expenditures and adjustments to the existing facilities to maintain electrical services to the existing customers. 6) That Owner pay the fair market value of $4,778 for Dempsey Street right-of- way from Nueces Bay Boulevard to Floral Street and $952 for the 10 -foot wide alley between Lots 1-10 and Lots 11-20, Block 3, Sunset Place for a total fair market value of $5,730. 7) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.690.vr May 11, 1995 That the foregoing ordinance was read fort e first time and passed to its second reading on this the L Day of i vl , 19 TRby the following vote: Mary Rhodes /��' Betty Jean Longoria 4.
