HomeMy WebLinkAbout022282 ORD - 07/25/1995AN ORDINANCE CLOSING AND ABANDONING A 10,656 -SQUARE FOOT PORTION OF A 60 -FOOT WIDE RIGHT-OF-WAY ON BRETT STREET, FROM JEAN STREET TO THE DEAD-END PORTION TERMINATING WITHIN THE WEST PROPERTY LINE OF TRACT 1A, OAKHURST PLAZA SUBDIVISION; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS; AND DECLARING AN EMERGENCY. WHEREAS, there exists a 10,656 -square foot portion of a 60 -foot wide right-of-way on Brett Street, from Jean Street to the dead-end portion terminating within the west property line of Tract 1A, Oakhurst Plaza, shown by plat recorded in Volume 568, Pages 95-96, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 10,656 -square foot portion of a 60 -foot wide right-of-way on Brett Street, from Jean Street to the dead-end portion terminating the west property line of Tract 1A, Oakhurst Plaza, as shown by plat recorded in Volume 568, Pages 95-96, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner pay the Fair Market Value of $207.56 for the street closure of the 60 -foot wide right-of-way on Brett Street. Fair Market Value Summary As Follows: a. Fair Market Value for Tract "A": $5,166.25, less credit for street dedication Tract "C": $3,204.50 and a 10 -foot utility easement dedication: $2,696.69 b. Fair Market Value for Tract "B": $4,595.00, less credit for street dedication Tract "D": $522.00 c. Fair Market Value for Tract "E": $3,177.50, less credit for a 5 -foot utility easement dedication: $4,758.60 and a 10 -foot utility easement dedication: $1,549.40 2) That Owner dedicate a 10 -foot wide utility easement inside and along the west property line of Brett Street and along the west property line of Tract 1 A, Oakhurst Plaza Subdivision, for an existing overhead primary line for use by CP&L. 95ag5000.725.vr July 19, 1995 022282 tia} LIVttu 3) That Owner dedicate a 10 -foot wide utility easement on the northside of the Brett Street right-of-way for existing telephone facilities for use by Southwestern Bell Telephone. 4) That Owner dedicate a 10 -foot utility easement running parallel along both the north side and the south side of the Brett Street right-of-way for use by the Water and Wastewater Divisions. 5) That Owner dedicate a 5 -foot wide utility easement along the east property line of Lot 1, Block C, Byron Willis Subdivision, and along the east property line of Lot 1, Block 1, Trade Center Subdivision for use by the City Gas Department. 6) That Owner dedicate and construct a standard "knuckle" sul-de-sac at the intersection of Brett Street and Jean Street. 7) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. SECTION 2. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at three regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25 day of DILL , 19 C1 ATTEST: Armando Chapa, City Secretary THE CITY OF CORPUS CHRISTI APPROVED: /9 DAY OF , 1995 JAMES R.
