HomeMy WebLinkAbout022302 ORD - 07/25/1995AN ORDINANCE AMENDING THE CORPUS CHRISTI CODE, CHAPTER 3, ADVERTISING, ARTICLE II, BILLBOARDS, SIGNBOARDS AND BULLETIN BOARDS, DIVISION 2, HIGHWAY BEAUTIFICATION ORDINANCE, SECTION 3-43, LICENSES, PERMITS AND FEES BY INCREASING PERMIT FEES AND ANNUAL FEES; PROVIDING FOR SEVERANCE; PROVIDING FOR AN EFFECTIVE DATE OF AUGUST 1, 1995; AND DECLARING AN EMERGENCY. Whereas, the City of Corpus Christi desires to amend the City of Corpus Christi Code of Ordinances to increase fees for billboards, signboards and bulletin boards contained in the Highway Beautification Ordinance; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI TEXAS: Section 1. That Chapter 3, Advertising, Article II, Billboards, Signboards and Bulletin Boards, Division 2, Highway Beautification Ordinance, Section 3-42 is amended as follows: DIVISION 2. HIGHWAY BEAUTIFICATION ORDINANCE Sec. 3-42. LICENSES, PERMITS AND FEES. (a) Only persons who hold valid licenses issued by the Texas Department of Transportation pursuant to the provisions of the Texas Highway Beautification Act may apply for and obtain building permits for signs regulated by this division. (b) Sign permits shall have an initial installation fee of one hundred and one dollars ($101.00) for each new sign erected after the effective date of this ordinance. An annual permit renewal fee shall be calculated for all such signs and for each sign existing on the effective date of this ordinance as follows: (i) For signs not exceeding 100 square feet in area, the fee is eleven ($11.00) ten dellars-($10.00) plus four cents ($0.04) thrcc ccnts ($0.03) per square foot of sign area. (ii) For signs greater than 100 square feet in area and not exceeding 300 square feet in area, the fee is twenty-six ($26.00) . . • . . e e plus four cents ($0.04) thrcc ccnts ($0.03) per square foot of sign area. 95N1-12830.601 022302 m 7 MItAirtlYtip 2 (iii) For signs greater than 300 square feet in area, the fee is thirty-seven ($37.00) plus four cents ($0.04) thrcc ccnts ($0.03) per square foot of sign area. SECTION 3. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word or provision hereof be given full force and effect for its purpose. SECTION 4. This ordinance to become effective August 1, 1995. SECTION 5. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25 day of a , 1995.
