HomeMy WebLinkAbout022304 ORD - 07/25/1995AN ORDINANCE AMENDING CHAPTER 18, FIRE PREVENTION CODE, ARTICLE I, GENERAL, CHAPTER 4, PERMITS AND CERTIFICATES, SECTION 403, PERMIT FEES, OF THE CITY CODE OF ORDINANCES BY INCREASING FEES IN THE CORPUS CHRISTI FIRE DEPARTMENT FIRE PREVENTION PERMIT FEE SCHEDULE; REPEALING ALL PREVIOUS PROVISIONS OF SECTION 403, PERMIT FEES AND ADDING A NEW SECTION 403, PERMIT FEES; PROVIDING A SAVINGS CLAUSE; AND DECLARING AN EMERGENCY; AND PROVIDING AN EFFECTIVE DATE OF AUGUST 1, 1995. WHEREAS, the City of Corpus Christi desires to amend the City of Corpus Christi Fire Prevention Code by with certain additions, deletions, and changes for regulatory purposes and in the interest of life and property protection; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Code of Ordinances of the City of Corpus Christi is hereby amended by increasing fees in the Corpus Christi Fire Department Fire Prevention Permit Fee Schedule by repealing Chapter 18, Fire Prevention Code, Article I, General, Chapter 4, Permits And Certificates, Section 403, Permit Fees, and replacing with a new Section 403, Permit Fees as follows: ARTICLE I. GENERAL Sec. 18-1 Fire Prevention Code. Burning permits will not be issued unless both the Fire Prevention and the Environmental Control Division approve the material to be burned. SECTION 2. If for any reason any section, paragraph, subdivision, clause, phrase, word or provision of this ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this ordinance for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose. SECTION 3. This ordinance to become effective August 1, 1995. SECTION 4. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the 25 day of , 1995.
