HomeMy WebLinkAbout022312 ORD - 08/08/1995AN ORDINANCE CLOSING AND ABANDONING A 6,660 -SQUARE FOOT PORTION OF A 10 -FOOT WIDE UTILITY EASEMENT WITHIN LOTS 7-C & 11-C, BLOCK 10, GARDENDALE UNIT 1; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 6,660 -square foot portion of a 10 -foot wide utility easement within Lots 7-C & 11-C, Block 10, Gardendale Unit 1, shown by plat recorded in Volume 37, Page 114, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said utility easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 6,660 -square foot portion of a 10 -foot wide utility easement within Lots 7-C & 11-C, Block 10, Gardendale Unit 1, as shown by plat recorded in Volume 37, Page 114, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner convey 4 parcels to the City for the Holly Road project as set out in the Real Estate Sales Contract between City and Owner in lieu of payment of the Fair Market Value of $12,238.00 for the 6,660 -square foot portion of the 10 -foot wide utility easement proposed for closure. 2) That Owner remove an existing 2 -inch gas line that extends between Lots 7-C & 11-C from service and abandon it in place and that Owner convert a 2 -inch gas line that extends along the rear of Lot 70-C to a service line. Owner will pay any expenses, as a result of the Gas Division abandoning or converting existing gas lines with the proposed easement closures. 3) That Owner dedicate a new easement for a new transformer to maintain service to the church buildings. 4) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.715.vr July 19, 1995 022312 7 4001 140 That the foregoing ordinance was read for the first time and passed to its second reading on this the 25 day of Juiti , 19 q5 by the following vote: Mary Rhodes Dr. Jack Best Betty Black Melody Cooper Tony Heldenfels That the la - Maryof C`� Mary Rhodes Dr. Jack Best Betty Black Melody Cooper Betty Jean Longoria John Longoria Edward A.
