HomeMy WebLinkAbout022313 ORD - 08/08/1995AN ORDINANCE CLOSING AND ABANDONING A 78 -SQUARE FOOT PORTION OF A 10 - FOOT WIDE UTILITY EASEMENT WITHIN LOT 20, BLOCK 1, WILLOWICK PLACE; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 78 -square foot portion of a 10 -foot wide utility easement within Lot 20, Block 1, Willowick Place, shown by plat recorded in Volume 49, Page 19, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said utility easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 78 -square foot portion of a 10 -foot wide utility easement within Lot 20, Block 1, Willowick Place, as shown by plat recorded in Volume 49, Page 19, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner pay the Fair Market Value of $35.00 for the 78 -square foot portion of the 10 -foot wide utility easement proposed for closure. 2) That Owner pay for relocating any Southwestern Bell Telephone Company facilities, if any, located within the 78 -square foot portion of the 10 -foot wide utility easement proposed for closure. 3) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.723.vr July 17, 1995 +i2'2. 13 T That the foregoing ordinance was read for the first time and passed to its second reading on this the 25 day of DU.
