HomeMy WebLinkAbout022314 ORD - 08/08/1995AN ORDINANCE CLOSING AND ABANDONING A 975 -SQUARE FOOT PORTION OF A 10 - FOOT WIDE UTILITY EASEMENT WITHIN LOTS 5&6, BLOCK 1, REFLECTIONS UNIT 4B; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 957 -square foot portion of a 10 -foot wide utility easement within Lots 5&6, Block 1, Reflections Unit 4B, shown by plat recorded in Volume 56, Page 106, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said utility easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 975 -square foot portion of a 10 -foot wide utility easement within Lots 5&6, Block 1, Reflections Unit 4B, as shown by plat recorded in Volume 56, Page 106, of the Map Records of Nueces County, Texas, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner dedicate a utility easement within Lots 5&6, Block 1, Reflections Unit 4B, approximately equal in area to the utility easement proposed for closure in lieu of paying the fair market value of the easements being closed. 2) That Owner pay $950.00 for the relocation of a 2 -inch gas line for use by the City Gas Division. 3) That Owner pay $3,500.00 to relocate an underground 7.2 KV primary cable for use by CP&L. 4) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.727.vr July 19, 1995 022314 That the foregoing ordinance was read for thefirst time and passed to its second reading on this the 25 day of J , 19 co, by the following vote: Mary Rhodes Dr. Jack Best Betty Black Melody Cooper Tony Heldenfels Betty Jean Longoria John Longoria Edward A.
