HomeMy WebLinkAbout022316 ORD - 08/15/1995AN ORDINANCE AMENDING THE ZONING ORDINANCE UPON APPLICATION BY RICK HILLIN, BY CHANGING THE ZONING MAP IN REFERENCE TO FLOUR BLUFF AND ENCINAL FARM AND GARDEN TRACTS, SECTION 41, BEING 8.76 ACRES OUT OF LOT 15 FROM "B-3" BUSINESS DISTRICT TO "RE" RESIDENTIAL ESTATE DISTRICT ON TRACT 1 AND "F -R" FARM -RURAL DISTRICT ON TRACT 2; PROVIDING FOR PUBLICATION; AND DECLARING AN EMERGENCY. WHEREAS, the Planning Commission has forwarded to the City Council its reports and recommendations concerning the application of Rick Hillin, for amendment to the zoning map of the City of Corpus Christi; WHEREAS, in accordance with proper notice to the public, a public hearing was held on Wednesday, July 12, 1995, during a meeting of the Planning Commission and on Tuesday, August 15, 1995, during a meeting of the City Council, in the Council Chambers at City Hall in the City of Corpus Christi allowing all interested persons to appear and be heard; and WHEREAS, the City Council has determined that the hereinafter set forth amendment would best serve public health, necessity and convenience and the general welfare of the City of Corpus Christi and its citizens. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. That the Zoning Ordinance of the City of Corpus Christi, Texas, is amended by making the change hereinafter set out. SECTION 2. That Flour Bluff and Encinal Farm and Garden Tracts, Section 41, being 8.76 acres out of Lot 15, located along the south side of Graham Road and along the west side of Flour Bluff Drive, be changed from "B-3" Business District to "RE" Residential Estate District on Tract 1 and "F -R" Farm -Rural District on Tract 2, metes and bounds attached as Exhibit A. SECTION 3. That the official zoning map of the City of Corpus Christi, Texas, be and the same is hereby amended as herein ordained. SECTION 4. That the Zoning Ordinance and Map of the City of Corpus Christi, Texas, approved on the 27th day of August, 1973, as amended from time to time, except as herein changed, shall remain in full force and effect. SECTION 5. That, to the extent that the amendment to the Zoning Ordinance set forth herein above represents a deviation from the Comprehensive Plan, the Comprehensive Plan is hereby 95NH2830.346 / 795-2 8/3/95 (i 2 2 316 2 amended to conform to the Zoning Ordinance as amended herein. SECTION 6. That all ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. SECTION 7. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi. SECTION 8. That upon written request of the Mayor or five Council members, copy attached, to find and declare an emergency due to the need for immediate action necessary for the efficient and effective administration of City affairs, such finding of an emergency is made and declared requiring suspension of the Charter rule as to consideration and voting upon ordinances at two regular meetings so that this ordinance is passed and shall take effect upon first reading as an emergency measure this the (t) day of (Z4,, , 1995. Hart, Assistan g Attorney 95NH2830.346 / 795-2 8/3/95 3 METES AND BOUNDS DESCRIPTION CASE NO. 795-2 TRACT 1 Description of a tract of land out of Lot 15, Section 41, Flour Bluff and Encinal Farm and Garden Tracts, Nueces County, Texas, containing 2.004 acres, more or less, being more particularly described as follows: BEGINNING at the Northwest corner of Lot 15, Section 41; THENCE, along the North line of Lot 15, A distance of 485.0 feet to the Northeast corner of this tract; THENCE, at right angles, a distance of 200.0 feet to the Southeast corner of this tract; THENCE, at right angles and parallel to the North line of Lot 15, a distance of 485.0 feet to a point on the West line of Lot 15, said point being the Southwest corner of this tract; THENCE, at right angles, along the West line of Lot 15, a distance of 200.0 feet to the POINT OF BEGINNING of this tract (containing 2.227 acres); SAVE AND EXCEPT a 20 foot wide strip parallel and adjacent to the North boundary of this tract previously dedicated as public road right-of-way, containing 0.223 acres, more or less. TRACT 2 Description of a tract of land out of Lot 15, Section 41, Flour Bluff and Encinal Farm and Garden Tracts, containing 6.763 acres, more or less, and being more particularly described as follows: BEGINNING at a point on the West line of Lot 15, from whence the Northwest corner of said Lot 15 bears in a Northeast direction 200.0 feet; THENCE, at right angles to the West line of Lot 15, a distance of 660.0 feet to a point on the East line of Lot 15, said point being the Northeast corner of this tract; THENCE, along the East line of said Lot 15, a distance of 460.0 to the Southeast corner of this tract; THENCE, at right angles to the East line of said Lot 15, and parallel to the North line of this tract, a distance of 660.0 feet to the Southwest corner of this tract; EXHIBIT A 4 THENCE, along the West line of said Lot 15, a distance of 460.0 feet in the Northwest comer and POINT OF BEGINNING of this tract, containing 7.037 acres); SAVE AND EXCEPT a 20 foot wide strip parallel and adjacent to the East boundary of this tract previously conveyed to the United States of America for railroad right-of-way, containing 0.274 acres, more or less.
