HomeMy WebLinkAbout022332 ORD - 08/22/1995AN ORDINANCE CLOSING AND ABANDONING A 43,122 -SQUARE FOOT PORTION OF THE TERMINAL STREET RIGHT-OF-WAY LOCATED ADJACENT TO LOTS 5-9, BLOCK 3, AND LOTS 13-19, BLOCK 5, NAVIGATION INDUSTRIAL PARK, SECTION 2; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS, AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 43,122 -square foot portion of the Terminal Street right-of-way located adjacent to Lots 5-9, Block 3, and Lots 13-19, Block 5, Navigation Industrial Park, Section 2, shown by plat recorded in Volume 27, Page 90, of the Map Records of Nueces County, Texas; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said right-of-way, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 43,122 -square foot portion of the Terminal Street right-of-way located adjacent to Lots 5-9, Block 3, and Lots 13-19, Block 5, Navigation Industrial park, Section 2, as shown by plat recorded in Volume 27, Page 90, of the Map Records of Nueces County, Texas, be and the same is hereby closed, for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That owner dedicate a right-of-way for Owner's future construction of a 100 - foot diameter cul-de-sac as indicated on the attached location map. 2) That owner pay Fair Market Value of $3,960 for the street closure of this portion of Terminal Street. 3) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.751_skp August 10, 1995 1/223:12 That the foregoing ordinance was read for thg first time and passed to its second reading on this the ,5 day of (1.
