HomeMy WebLinkAbout022333 ORD - 08/22/1995AN ORDINANCE CLOSING AND ABANDONING A 3,240 -SQUARE FOOT PORTION OF A 12 -FOOT WIDE UTILITY EASEMENT WITHIN LOT 1, BLOCK A, BROOKHAVEN ANNEX; SUBJECT TO COMPLIANCE WITH THE SPECIFIED CONDITIONS; AND THE REPLATTING OF THE PROPERTY WITHIN 180 DAYS. WHEREAS, there exists a 3,240 -square foot portion of a 12 -foot wide utility easement within Lot 1, Block A, Brookhaven Annex, shown by plat recorded in Volume 51, Page 159, of the Map Records of Nueces County, Texas, which 12 -foot wide utility easement was dedicated by an easement filed of record in Volume U, Page 470 of the Nueces County Deed Records; WHEREAS, it has been determined that it is feasible and advantageous to the City of Corpus Christi to abandon said utility easement, subject to the provisions listed below; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI: SECTION 1. That a 3,240 -square foot portion of a 12 -foot wide utility easement within Lot 1, Block A, Brookhaven Annex, as shown by plat recorded in Volume 51, Page 159, of the Map Records of Nueces County, Texas, which 12 -foot wide utility easement was dedicated by an easement filed of record in Volume U, Page 470 of the Nueces County Deed Records, be and the same is hereby closed for public use and every municipal purpose, subject to the following specified conditions as part of closure: 1) That Owner pay Fair Market Value of $4,860 for the 3,240 -square foot portion of a 12 -foot wide utility easement. 2) That Owner replat the property within 180 days at his expense; provided however, the City Engineer may extend the time limit for an additional one hundred eighty (180) days if extenuating circumstances outside the Owner's control necessitate an extension. 95ag5000.750.skp August 11, 1995 U22; 33 r waIYROFfl MMMFt!
