HomeMy WebLinkAbout022351 ORD - 09/12/1995AN ORDINANCE AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO EXECUTE AN AMENDMENT TO THE LEASE WITH THE UNITED STATES OF AMERICA (NATIONAL WEATHER SERVICE) AUTHORIZED BY ORDINANCE NO. 021822, APPROVED ON DECEMBER 14, 1993, BY DECREASING THE ORIGINAL PREMISES FROM 5.663 ACRES AND BY ADDING A SECOND PREMISES, INCLUDING TEMPORARY AND PERMANENT EASEMENTS, FOR THE RADAR DOME, WHICH IS AN INTEGRAL PART OF THE NEXT GENERATION RADAR (NEXRAD) FACILITY; AND PROVIDING FOR PUBLICATION. WHEREAS, the National Weather Service constructed an office building and a balloon launching site on the 5.663 acres original leased premises, but could not construct the NEXRAD radar dome on the original leased premises due to potential interference with air traffic control; and WHEREAS, the National Weather Service has requested another site on the Corpus Christi International Airport upon which to construct the NEXRAD radar dome that will not interfere with air traffic control and needs to lease those premises, including temporary construction easements, and a permanent easement, from the City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF CORPUS CHRISTI, TEXAS: SECTION 1. That the City Manager, or his designee, is hereby authorized to execute an amendment to the Lease with the United States of America (National Weather Service), authorized by Ordinance No. 021822, approved on December 14, 1993, by decreasing the original premises from 5.663 acres to approximately 4.4 acres, more or less, as shown on the attached and incorporated Exhibit C, and by adding a second premises to the Lease of approximately 0.476 acres together with an adjacent temporary construction easement of approximately 0.727 acres, and a three foot (3') access easement together with an adjacent fifteen foot (15') temporary construction easement, as shown on the attached and incorporated Exhibit B, a copy of which is on file with the City Secretary. SECTION 2. That in lieu of an annual rental fee for use of the Premises, the City of Corpus Christi will receive a weather forecast facility that will increase the National Weather Service's ability to provide timely and critical severe weather reports and services to airlines and residents of the Coastal Bend. SECTION 3. Publication shall be made in the official publication of the City of Corpus Christi as required by the City Charter of the City of Corpus Christi.
