HomeMy WebLinkAbout022373 ORD - 10/10/1995AN ORDINANCE AUTHORIZING AND ALLOWING, UNDER THE ACT GOVERNING THE TEXAS MUNICIPAL RETIREMENT SYSTEM, RESTRICTED PRIOR SERVICE CREDIT TO EMPLOYEES WHO ARE MEMBERS OF THE SYSTEM FOR SERVICE PREVIOUSLY PERFORMED FOR CERTAIN SPECIFIC PUBLIC ENTITIES FOR WHICH THE EMPLOYEES HAVE NOT OTHER- WISE RECEIVED CREDITED SERVICE; ESTABLISHING AN EFFECTIVE DATE FOR THE ORDINANCE; AND PROVIDING FOR SEVERANCE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CORPUS CHRISTI, TEXAS: SECTION 1. AUTHORIZATION OF RESTRICTED PRIOR SERVICE CREDIT (a) On the terms and conditions set out in Section 853.305 of Subtitle D of Title 8, Texas Government Code, as amended (hereinafter referred to as the "Act"), each employee of the City of Corpus Christi (hereinafter the "City"), who is now a member of the Texas Municipal Retirement System (hereinafter the "System") or who hereafter becomes an employee of the City and member of the System, shall be eligible to receive Restricted Prior Service Credit for service previously performed as an employee of any of the entities described in Section 853.305, provided that (1) the person has not otherwise received credited service in the System for such service, and (2) such service meets the requirements of said Section 853.305. (b) The service credit hereby granted may be used only to satisfy length -of -service requirements for retirement eligibility, has no monetary value in computing the annuity payments paid by the System, and may not be used in other computations, including computation of Updated Service Credits. (c) An employee seeking to establish Restricted Prior Service Credit under this ordinance must take the action required under said Section 853.305 while still an employee of the City. 73 M1t,ROFILMEU Page 2 SECTION 2. EFFECTIVE DATE Subject to approval by the Board of Trustees of the Texas Municipal Retirement System, Restricted Prior Service Credit shall be and become effective on the 1st day of October, 1995. SECTION 3. SEVERANCE If for any reason, any section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance shall be held invalid or unconstitutional by final judgment of a court of competent jurisdiction, it shall not affect any other section, paragraph, subdivision, clause, phrase, word or provision of this Ordinance, for it is the definite intent of this City Council that every section, paragraph, subdivision, clause, phrase, word, or provision hereof be given full force and effect for its purpose.
